Vstup ČR do EU: začátky uplatňování práva ES v českém prostředí

Abstract:

Diplomová práce se zabývá problematikou přístupu České republiky do Evropské unie se zvláštním zřetelem na počátky uplatňování evropského práva v českém právním řádu. V úvodní části je stručně nastíněna historie vzniku EU a status tzv. přidružené země, jež ČR měla před vstupem do EU a v souvislosti s tímto statutem je analyzována i problematika právního charakteru tzv. Evropské dohody o přidružení ČR k EU. Pro ilustraci této povahy byly vybrány dva rozsudky Evropského soudního dvora. Další rozsáhlá část práce se zabývá problematikou sbližování práva, jak z obecného hlediska, tak konkrétně z hlediska ČR. Zvláštní pozornost je z důvodu jejich povahy věnována otázce implementace směrnic a případným následkům jejich nesprávné či žádné imlementace. V této části jsou rovněž rozebrána přechodná období pro ČR, jež se podařilo vyjednat. Část práce zabývající se propojením národního právního řádu členského státu s evropským právním prostředím je výhradně zaměřena na tzv. prejudiciální řízení, z důvodů speciálního postavení ESD coby instituce oprávněné podávat závazný výklad evropského práva. Závěrečná část práce se zaměřuje na aktuální otázky evropského práva. Jednak je popsána hodnotící zpráva Komise těsně před vstupem ČR do EU, dále následuje aktuální hodnocení ČR Komisí. Rovněž jsou popsány případy administrativních řízení vedených Komisí proti ČR. Poslední část práce je zaměřena na konkrétní uplat- ňování práva ES v ČR. Bylo bohužel konstatováno, že k uplatňování práva ES v ČR zatím příliš nedochází, nejen z důvodu nedostatku časové působnosti (souvisí s "opožděností" českých soudů, které v současné době řeší případy z doby před vstupem do EU), ale také z důvodu nedostatku informací o tomto právu.

Abstract:

This diploma work is concerned with the process of the Czech Republics accessing the European Union with special emphasis being put on the beginning of applying the European law in the Czech legal order. The introduction part is aimed on the history of establishing the EU in brief. After that, the status of an "associated" country has been described; the status which the Czech Republic had before its eventual accession. Alongside with this, the legal character of the so-called European Treaty on the Czech Republics Association to the EU has been analysed. To illustrate such a legal character two judgments of the European Court of Justice have been chosen. Another complex part of this diploma then concerns with the problems of harmonization of a national legal system with the European legislation, both from the general and also from the Czech point of view. Special attention has been paid, due to their legal character, to the problematics of the implementation of Directives and possible consequences of their missing implementation or inappropriate implementation. In this area, also the temporary exceptions for the CR, which had been negotiated successfully, have been analysed. Following part of this diploma work aimed on connections between the national and the European legal environment then describes only the institution of the preliminary ruling according to the fact that the European Court of Justice is of a special importance as an institution which is entitled to give a binding interpretation of the European law. The final part of this work is then contemplating several current questions which the EU and the CR has to solve nowadays. Firstly, the European Commissions monitoring report on the CRs preparation for membership (issued shortly before the CRs actual accession) has been described, secondly, an analysis of a current Commissions report has been given. Thirdly, the cases where the Commission took a legal action against the CR, have been described (infringement procedures against the CR). Finally, the attention has been drawn to the application of the EU law in the Czech Republic, which has unfortunately been put on the slow burner and due to this fact it has therefore been concluded that the Czech Republic starts with the EU laws application quite hesitatingly.
