The development of the selfgovernment in the second half of the 19. century

Abstract:

Moje bakalářská práce zachycuje jedno ze složitějších období života českého národa. Podle jednotlivých kapitol začínám úvodem, kde přibližuji cíl mé práce, kdy končí feudalismus a začíná doba tvorby reforem veřejné správy. Složitým a nutným vývojem vyústila vznikem samostatného Československa 28.10.1918. V další části je uvedena podstata územní samosprávy, týkající se povahy, funkcí, rozdílu mezi samosprávou veřejnoprávní a soukromoprávní, dále členění samosprávy, výkon státní správy samosprávnými orgány a poslání územní samosprávy. Další kapitola je věnována vývoji v letech 1848-1918, v členění na etapy vývoje moderního státu, a to 1848-1860, 1860-1867, 1867-1871 a 1871-1918. Dále se v další kapitole zabývám ústavnímu vývoji v letech 1848-1867, a to v členění na ústavu dubnovou z roku 1848, ústavu březnovou z roku 1849, dále dobou nástupu bachovského absolutismu, říjnovým diplomem z roku 1860, únorovou ústavou z roku 1861 a prosincovou ústavou z roku 1867. Poslední a velmi důležitá kapitola se týká vývoje územní samosprávy v letech 1848 až 1918, kdy v první části se věnuji obecnému vývoji po revoluci roku 1848, další velká kapitola zachycuje obecní samosprávu, v členění na prozatímní obecní zřízení z roku 1849, zásady o organických zřízeních v korunních zemích rakouského císařského státu z roku 1852 a závěrem se věnuji dobudování obecní územní samosprávy po vydání ústavy v roce 1861, v členění na podkapitoly dozor nad samosprávou a oblast statutárních měst. Další velká kapitola této části je věnována samosprávě okresní a poslední samosprávě zemské. V závěru shrnuji svou práci a tím přehled celého vývoje územní samosprávy v českých zemích ve druhé polovině 19. století. Z celé moji bakalářské práce vyplývá jakou dlouhou etapou procházel vývoj územní samosprávy, kolik generací se snažilo pozitivně či negativně ovlivňovat život generací českého národa. Bylo to poznamenáno často obrovskou snahou, či hrdinstvím jedinců, spolků, organizací, směřující k jedinému cíli řídit co nejlépe územní samosprávu a možnost ji aktivně ovlivňovat.

Abstract:

My thesis reflects one of the difficult periods in the life of the Czech nation. According to the chapters I start with the Introduction in which I explain the aim of my work the end of feudalism and the start of a period when the reforms of public administration were created. Through difficult and necessary evolution this period resulted in the foundation of a new independent state Czechoslovak republic on 28th October 1918. In the next part I state the basics of the territorial self-government regarding the characteristic, function and the difference between the self-government governed by public law and private law, then the division of self-government, the execution of state administration by self-governing institutions and the function of territorial self-government. The next chapter is devoted to the development between years 1848 and 1918. I divide this era into the periods of development of a modern state: 1848-1860, 1860-1867, 1867-1871 and 1871-1918. In the next chapter I describe the development of constitution dividing it into April Constitution (1848). March Constitution (1849), the beginning of Bachs absolutism, The October Diploma (1860), February Constitution (1861) and December Constitution (1867). The last and very important chapter relates to the development of territorial self-government between years 1848 and 1918. In the first part I describe the general development after the revolution in 1848. Another extensive chapter reflects communal self-government in division into temporary communal constitution (1849), the principals of organic constitution in the crown lands of Austrian Empire (1852) and in the end I describe the finishing of local territorial self-government after issuing the Constitution in 1861 by dividing it into two shorter chapters Supervision of self-government and The sphere of corporate towns. Another big chapter of this part is devoted to district self-government and the last one to the provincial self-government. In the Conclusion I summarize the outline of the development of territorial self-government in the Czech lands in the second half of 19th century My thesis shows how long the development of territorial self-government was, how many generations have influenced the life of Czech nation in both positive and negative way. This development was often characterized by enormous effort and heroism of individuals, clubs and organisations which aimed at one object to administer the territorial self-government as effectively as possible and to have a chance to influence it actively.
