Limits of flexible regulation of working hours in labour code´s regime

Abstract:

Moje diplomová práce pojednává o limitech flexibilní úpravy pracovní doby v režimu zákoníku práce. V souvislosti s neustálou potřebou efektivnějšího využívání pracovní doby a se vznikem nových flexibilních forem zaměstnávání je zvolené téma v oblasti pracovního práva velmi aktuální a jak ukázala současná ekonomická recese i jedním z možných částečných východisek a řešení problémů v oblasti pracovněprávních vztahů. Práce je vypracovávána v době kdy jíž platí prakticky 3 roky poslední téměř nezměněné znění zákoníku práce. Diplomová práce je koncipována do 8 základních částí . První část ? úvod do problematiky slouží jako všeobecné seznámení se základními pojmy v oblasti pracovního práva a flexibilní úpravy pracovní doby. Část druhá ? Geneze právní úpravy pracovní doby na území České republiky a pracovní zákonodárství od r. 1948 do dnešní doby shrnuje legislativní vývoj , kterým prošlo pracovní právo v ČR v uvedeném období. Jde víceméně o souhrn historických dat a konstatování. V průběhu tohoto období došlo k velmi razantním změnám ve smyslu a chápání či pojetí pracovního práva. Část třetí ? uplatnění základních zásad pracovněprávních vztahů v oblasti pracovní doby se soustředí zejména na právo zaměstnance na přidělování práce v rozsahu stanovené týdenní pracovní doby a na rozvržení pracovní doby podle § 13 odst. 3 zákoníku práce. Dále na zásadu ? zákazu dvojí práce u téhož zaměstnavatele? dle § 13 odst. 4 zákoníku práce. A na uplatnění zásady dobrých mravů dle § 14 odst. 1 zákoníku práce. Část čtvrtá ? pojem pracovní doby je kapitolou zabývající se všeobecně pracovní dobou jako jedním ze základních pilířů pracovněprávních vztahů. Kapitola pojednává i o existenci směrnic Rady evropy a jejich vlivu na české zákonodárství v oblasti pracovního práva. Část pátá - flexibilita pracovní doby a limity pracovněprávní úpravy je podstatou celé diplomové práce a tato část je rozvržena do několika podkapitol. Jde mimo jiné o rozvržení a délku pracovní doby, pracovní pohotovost, práce přesčas, noční práci, konto pracovní doby a některé formy flexibilní úpravy pracovní doby nebo zaměstnávání. Část šestá ? evidence pracovní doby specifikuje podmínky její evidence, povinnost zaměstnavatelů a jakým způsobem při tom spolupracují zaměstnanci. Taktéž jsou zde obsaženy důvody proč je nutné pracovní dobu evidovat a v jakých případech. Část sedmá ? srovnání české právní úpravy se zahraniční právní úpravou, úvahy de lege ferenda je zevrubným srovnáním jednotlivých flexibilních forem zaměstnávání a pracovní doby v ČR s okolními členskými státy EU. Je zde prezentován i osobní názor autorky diplomové práce na současné znění zákoníku práce. Část osmá - závěr shrnuje poznatky získané při zpracování diplomové práce.

Abstract:

My thesis deals with the limits of flexible arrangements of working hours in the Labour Code regime. The subject chosen from the field of labour law is very up-to-date within the context of continuous need for effective use of working hours and in connection with rise of new flexible forms of employment. Taking into account the current economic crisis, the theme may be one of possible resource and the solution of problems in the field of labour-law relations. The thesis was written at the time when the latest, almost unmodified, version of Labour Code has been valid practically for three years. The thesis is divided into eight basic parts. Part 1 ? introduction to the issues serves as a general identification to the basic concepts in the field of labour law and flexible arrangements of working hours. Part 2 ? Genesis of the working hours? legal form in the territory of the Czech Republic and the labour legislation from the year 1948 to the present, summarizes legislative developments of the Czech labour law at that time. It is a summary of historical data and statement. There were huge amendments in the text, varying the meaning, understanding and conception of labour law within this period. Part 3 ? claiming the basic principles in labour-law relations in the field of working hours, focusing especially on employee?s right to allocation of work within the defined weekly hours of work and right to working hours? layout according to § 13 paragraph 3 of the Labour Code, further, on principle of prohibition of dual employment at the same employer according to § 13 paragraph 4 of the Labour Code, and on claiming the principle of good manners according to § 14 paragraph 1 of the Labour Code. Part 4 ?concept of working hours is the chapter considering working hours as one of the basic pillars of labour-law relations. The chapter is about existence of Council of Europe directives and their influence over the Czech legislation in the field of labour law. Part 5 ? flexibility of working hours and limits of labour-law arrangements is the essence of my thesis. This part is divided into several subheadings, such as length of working hours, emergency ? on call, overtime, night work, working hours? account, some forms of flexible arrangements of working hours or employment. Part 6 ? register of working hours specifies conditions of working hours? registration, employers? obligation and ways of employees? cooperation. There are also mentioned within, reasons why it is necessary to register working hours and the cases in which registration is necessary. Part 7 ? comparison of the Czech legislation and foreign legislation, lege ferenda consideration is detailed comparison of single flexible forms of employment and working hours in the Czech Republic, compared to the neighbouring EU Member States. The chapter includes the author?s personal opinion of the current statutory text. Part 8 ? conclusion summarizes the knowledge gained during compilation of the thesis.
