Direct Election of the Mayor of the Municipality

Abstract:

V mé diplomové práci se zabývám právním postavením starosty obce a možností zavedení přímé volby starosty obce. Pro vymezení orgánů obce jsem považoval za nutné objasnit i právo na územní samosprávu. Protože starosta není jediný orgán v obci, dále se zabývám i jednotlivými orgány obce a jejich vztahem ke starostovi včetně zahraniční komparace. V další části se zaměřím na možnost zavedení přímé volby starosty obce, kde uvádím i praktickou část formou ankety starostům vybraného dobrovolného svazku a důsledky zavedení přímé volby starosty pro jeho funkci i obec. Cílem diplomové práce je vyhodnocení postavení funkce starosty v obci a možnost zavedení přímé volby starosty občany. V závěru uvádím zhodnocení a smysl možného zavedení přímé volby starostů.

Abstract:

In my diploma thesis I deal with the legal position of the mayor of the municipality and a possibility of establishing the direct election of the mayor of the municipality. In order to define the municipality´s bodies I consider as to be necessary to clarify also the right to a regional self-government. As the mayor is not the only body in the municipality, furthermore I also deal with the individual municipality´s bodies and their relationship to the mayor including a comparison with foreign countries´ situation. In subsequent section of the thesis I focus on a possibility of establishing the direct election of the mayor of the municipality, where I mention also the practical part in the form of a survey of the mayors of the selected voluntary union of municipalities and consequences of introducing the direct election of the mayor for his/her office and the municipality. The objective of my diploma thesis is the evaluation of the mayor´s position of the office in the municipality and a possibility of establishing the direct election of the mayor by citizens. In conclusion I mention the evaluation and meaning of a possible introduction of the direct election of the mayors.
