Superficiary Right of Building

Abstract:

Tato diplomová práce se zabývá právem stavby, které bylo do našeho právního řádu znovu zavedeno zákonem č. 89/2012 Sb., občanský zákoník, ve znění pozdějších předpisů. Právo stavby představuje oprávnění umístit a vlastnit stavbu na cizím pozemku. Toto oprávnění je dočasné a svým způsobem výjimečné, neboť se jedná o výjimku ze superficiální zásady. Jednotlivé kapitoly postupně představí historický exkurz, základní pojmové znaky práva stavby, postupy vzniku, změn a zániku práva stavby a také vazbu do katastru nemovitostí. Cílem této práce je zkoumat, které stavby lze realizovat v rámci práva stavby. Práce propojuje soukromoprávní institut práva stavby se souvisejícími veřejnoprávními předpisy a hledá odpověď na otázku, zda je tento zajímavý institut použitelný také pro stavby, které představují výjimku z § 498 zákona č. 89/2012 Sb., občanského zákoníku, ve znění pozdějších předpisů. Práce užívá zejména metody popisné, analýzy právního textu za využití interpretačních metod, metody kompilace a komparace s rakouskou právní úpravou.

Abstract:

This diploma thesis deals with superficiary right of building, which has been reintroduced into our legal order by the Act No. 89/2012 Coll, the Civil Code, as amended. The superficiary right of building is the right to build or own a building on a foreign land. This authorisation is temporary and, in a way, exceptional, as it is an exeption of the superficies solo cedit principle. Individual chapters gradually introduce a historical excursion, the fundamental attributes of the superficiary right of building, the procedures for the creation, changes and termination of the superficiary right of building, as well as the link to the real estate cadastre. The aim of this thesis, is to investigate, which buildings can be realized in mode of superficiary right of building. This thesis connects the private law institute of superficiary right of building with related public law regulations and seeks an answer to the question of whether this interesting institute, is also applicable to buldings, which are an exeption of § 498 Act No. 89/2012 Coll, the Civil Code, as amended. The final thesis uses descriptive methods, analysis of legal text using interpretation methods, methods of compilation and comparison with Austrian legislation.
