Legal and Eeconomic Aspects of Tendering for Providing Transport Serviceability

Abstract:

Obsahem diplomové práce jsou právní a ekonomické aspekty nabídkových řízení při zajišťování dopravní obslužnosti. Diplomová práce vymezuje základní charakteristiku fiskální části finančního práva v návaznosti na zakotvení právní úpravy dané problematiky v evropském a vnitrostátním právu. V rámci tématu se autorka zabývá kategorizací řízení, prostřednictvím kterých mohou územně samosprávné celky volit dopravce zajišťující dopravní obslužnost, a to s poukázáním na problematické souvislosti v teorii a praxi. Pozornost je také věnována problematice uzavírání smluv s charakterem mandatorního výdaje územně samosprávného celku.

Abstract:

The content of the thesis are the legal and economic aspects of tendering in the provision of transport services. This thesis defines the basic characteristics of fiscal finance law in relation to the anchoring of the regulatory issues in the European and national law. Within the topic the author deals with the categorization procedure through which local governments can choose the operator providing transport services, and with reference to the problematic relation in the theory and practice. Attention is also paid to the issue of contracting relating the characteristics of mandatory nature of expenses of a territorial self-governing unit.
