Abstract:

Abstrakt Diplomová práce se věnuje problémům souvisejícím s podáváním stížností proti postupům správce daně, respektive proti jednání pracovníků správce daně vykonávaným v průběhu jednotlivých dílčích částí daňového řízení. Východiskem práce je pohled pracovníka správce daně založený na praktických zkušenostech s vyřizováním jednotlivých druhů stížností, které jsou uplatňovány osobami zúčastněnými na správě daní v průběhu vzájemných společenských vztahů vznikajících při aplikaci zákonů, kterými jsou ukládány daně a poplatky. V úvodní kapitole se práce zaměřuje na charakteristiku jednotlivých druhů stížností, s nimiž se správce daně setkává při své činnosti, včetně připomínky historického vývoje používání institutu stížnosti jako jednoho z prostředků ochrany zákonnosti v daňovém řízení. Úvodní část práce obsahuje také autorův pohled na právní základy ukotvení stížnosti jako legitimního prostředku odporu proti postupu správního orgánu a jeho pracovníků. Další kapitoly popisují proces vyřizování jednotlivých stížností, včetně dopadu podání stížnosti do daňového řízení. Pozornost je zde věnována především úvahám o tom, do jaké míry lze používat stížnosti jako prostředek obstrukce na straně jedné, a úvahám o tom, do jaké míry může správce daně svými postupy respektujícími procesní zásady daňového řízení společně s principy dobré správy předcházet podávání stížností. Závěr práce obsahuje vyhodnocení poznatků autora vycházejících z jeho dlouholeté činnosti pracovníka správce daně podílejícího se na vyřizování stížností v daňovém procesu a také náměty vycházející z analýzy předmětné problematiky s návrhy možných změn de lege ferenda.

Abstract:

Abstract The final thesis deals with the issues related to the filing complaints against the tax administrator's procedures, or more precisely, against the behaviour of the tax administrator's employees in the course of the individual parts of tax proceedings. The starting point of the thesis is the view of the tax administrator's worker based on the practical experience with handling individual types of complaints which are asserted by persons involved in tax administration in the course of mutual social relations arising from the application of laws imposing taxes and fees. In the introductory chapter the thesis focuses on the characteristics of the various types of complaints that the administrator encounters in their activities including a reminder of the historical evolution of the use of the Complaint Institute as one of the means of protecting legality in tax proceedings. The introductory part also containts the author's attitude to the legal basis embedding the complaint as a legitimate means of opposing the procedure of the administrative authority and their workers. Other chapters describe the process of handling individual complaints including the impact of filing a complaint on tax proceedings. The particular attention is paid to the extent to which the complaint can be used as a means of obstruction on one hand and on the other hand to the consideration of the extent to which the tax administrator can prevent filing complaints by their procedures respecting the procedural principles of tax proceedings together with the principles of good governance. The conclusion of the thesis contains an evaluation of the author's knowledge based on his long-term activity as a tax administrator involved in handling complaints in the tax process and also suggestions based on the analysis of the issue with the proposals for possible changes de lege ferenda.
