Decision making about students rights and duties - after the Act on Higher Education Institutions amendment

Abstract:

Tématem této práce bylo rozhodování ve věcech práv a povinností studentů po novele zákona o vysokých školách (zákonem č. 137/2016 Sb.) se zaměřením na uplatnění správního řádu v těchto řízeních. Práce podává výčet institutů obecné a speciální právní úpravy rozhodování o právech a povinnostech uchazečů o studium a studentů. Věnuje se právní úpravě postavení vysokých škol se zaměře-ním na veřejné vysoké školy. Práce dále obsahuje výčet nejdůležitějších změn zákona o vysokých školách obsažených ve výše citované novele a jejich dopad zejména na individuální rozhodování o právech a povinnostech studentů.

Abstract:

The topic of this thesis was decision-making in matters of rights and obligations of students after the Higher Education Act Amendment (Act No. 137/2016 Coll.) and the application of the Administrative Procedure Code in these procee-dings. The thesis summarizes institutes of general and special legal regulation of decisions about the rights and obligations of applicants for study and students. The thesis also deals with the legal status of universities with a focus on public higher education institutions. The thesis also contains a list of the most important changes of the Higher Education Act contained in the above mentioned amend-ment and their impact on individual decision-making on students' rights and obli-gations.
