Abstract:

Předkládaná práce pojednává o hlavních úpadkových trestných činech, tedy o trestných činech úzce spjatých se závazkovými vztahy mezi dlužníkem a věřiteli, s úpadkem dlužníka a jeho případným řešením v insolvenčním řízení. Nový trestní zákoník přijatý zákonem č. 40/2009 Sb. (dále také "TrZ") sice právně nedefinuje stav úpadku ani neobsahuje samostatnou hlavu týkající se úpadkových trestných činů, avšak teorie a praxi považuje za jádro úpadkových trestných činů trestný čin poškození věřitele, zvýhodnění věřitele, způsobení úpadku, porušení povinnosti v insolvenčním řízení, pletichy v insolvenčním řízení obsažených v § 222 až § 226 TrZ. Práce má za cíl nabídnout syntetický výklad, který bude pro čtenáře přívětivý a poskytne co nejvíc poznatků o úpadkových trestných činech a jejich vztahu k úpadkovému právu,k otázce pachatele úpadkových trestných činů, ale také k předpokladům trestní odpovědnosti za jejich spáchání, a to i s ohledem na zásadu subsidiarity trestní represe. To vše za předpokladu pochopení širšího společenského rámce, zahrnujícího také historický exkurz. Práce je členěna na deset kapitol. Druha kapitola nabízí stručný historický kontext vývoje ochrany závazkových právních vztahů či zjednodušeně ochrany věřitelů. Třetí a čtvrtá kapitola má za cíl nastínit souvislost mezi postihováním úpadkových trestných činů a socioekonomickými otázkami, a zároveň základním způsobem vymezit vztah k civilnímu a potažmo insolvenčnímu řízení, jehož součástí je obecný výklad k institutům insolvenčního práva,jež jsou společné pro všechny úpadkové trestné činy. Páta kapitola přináši stručnou komparaci současné a předchozí právní úpravy. Těžiště práce je obsaženo v kapitole šesté, která představuje podrobný a souvislý výklad jednotlivých úpadkových trestných činů a jejich jednotlivých zákonných skutkových znaků, při kterém se autor pokusil vytěžit aktuální a předchozí použitelnou judikaturu. Sedmá kapitola vymezuje přidružený trestný čin k úpadkovým trestným činům. Osmá kapitola přináší stručný nástin Německé právní úpravy insolvenčních trestných činů. V závěru práce se autor pokusil shrnout stěžejní otázky vztahující se k trestnímu postihu úpadkových trestných činů, včetně otázek de lege ferenda.

Abstract:

The submitted master thesis elaborately discusses primary bankruptcy crimes, implying crimes closely connected with contractual obligations between the debtor and creditors, bankruptcy and its resolution in an insolvency proceeding. Although, the new criminal codex passed by Act. No. 40/2009 Coll., Criminal Code, does not give the definition of the matter of bankruptcy, neither contains separate part related to insolvency crimes, theory and practice consider to be the primary insolvency crimes damage of the creditor, preferential treatment of the creditor, causing bankruptcy, breaching the obligation in the insolvency proceeding and plotting in the insolvency proceeding, contained in articles no. 222 up to no. 226 of the Criminal Code. The aim of the thesis is to offer a synthetic presentation, pleasant for the readers and offers the maximum knowledge of insolvency crimes and its relation to insolvency law, of its offender, as well as the requirements of criminal and responsibility for their committing in regard of the subsidiarity of criminal repression principle. All of this in an assumption of understanding broader social scope included historical context. The thesis is divided into ten chapters. The second chapter offers the historical context of the development of the protection of contractual obligations, simply of the protection of the creditors from the perspective of the criminal law. The third and fourth chapter aims to outline the link between penalizing for insolvency crimes and social-economic matters, and yet they define in a basic manner the relationship between civil law and insolvency law, which contains basic commentary to the institutes of insolvency law Common to all insolvency crimes. The fifth chapter assumes a brief comparison of current and previous legislation. The main, sixth part of the work, introduce a detailed and comprehensive commentary of particular bankruptcy crimes and its legal constitutions with the aid of actual and previous practice of the courts. The seventh chapter defines an associated offense to insolvency offenses. The eighth chapter gives a brief outline of the German legal regulation of insolvency crimes. The final part of the thesis summarizes crucial issues referring to bankruptcy crimes, including de lege ferenda proposals.
