The Detention according to the valid Czech Penal Proceeding

Abstract:

The diploma thesis deals with the detention institution according to valid Czech criminal procedural law. In the thesis there is a break up of detention, one of the reinsurance institutions, its meaning and purpose, as well as its position within the criminal procedural law. The introduction of the thesis defines the concept of detention, describes its constitutional framework and the basic principles influencing this institute. In the next chapter of the thesis there is an analysis of the legal regulation of detention, of individual types of detention, including their mutual comparison, as well as the analysis of other insurance institutions connected with it. The following section deals with the substantive consequences of detention and compensation for the damage that may arise in connection with detention. The conclusion of the thesis is devoted to the deliberations of de lege ferenda and provides a brief summary of the institute.

Abstract:

Diplomová práca sa zaoberá inštitútom zadržania podľa platného českého trestného procesného práva. V práci je rozoberané zadržanie, jeden zo zaisťovacích inštitútov, jeho význam a účel, rovnako ako jeho postavenie v rámci trestného práva procesného. V úvode práce je zadefinovaný pojem zadržanie, popísaný jeho ústavnoprávny rámec a základné zásady ovplyvňujúce tento inštitút. V ďalšej kapitole práce sa nachádza analýza zákonnej úpravy zadržania, jednotlivých druhov zadržania vrátane ich vzájomnej komparácie, ako aj rozbor ostatných zaisťujúcich inštitútov s ním spojených. Nasledujúca časť sa zaoberá hmotnoprávnymi dôsledkami zadržania a náhradou škody, ku ktorej môže prísť v súvislosti so zadržaním. Záver práce je venovaný úvahe o návrhoch de lege ferenda a poskytuje stručné zhrnutie daného inštitútu.
