Diversions in criminal proceeding

Abstract:

Rigorózní práce je zaměřena na problematiku odklonů v českém trestním řízení. Práce si klade za cíl zhodnotit platnou právní úpravu odklonů, prezentovat jednotlivé návrhy de lege ferenda a nastínit předpokládaný vývoj této právní úpravy v budoucnu. V první části práce jsou představena obecná východiska alternativního řešení trestních věcí ve světle mezinárodně uznávaného konceptu restorativní justice. Dále jsou definovány charakteristické znaky odklonů a jejich účel. Postupně je věnována pozornost jednotlivým typům odklonům, a to podmíněnému zastavení trestního stíhání, narovnání, odklonům aplikovaným v trestním řízení proti mladistvým, odklonům aplikovaným ve zkráceném přípravném řízení, trestnímu příkazu a dohodě o vině a trestu. Následně jsou představeny vybrané zahraniční právní úpravy odklonů, konkrétně právní úprava rakouská a slovenská. Závěrečná část práce zpracovává statistické údaje aplikace odklonů v České republice v období 2012-2016, jakož i některé problémy současné právní úpravy odklonů. Zároveň je pojednáno o budoucí právní úpravě odklonů, a to zejména v souvislosti s připravovanou rekodifikací trestního řádu.

Abstract:

The doctoral thesis primarily focuses on the subject of diversions in terms of the criminal proceedings in the Czech republic. The main aim of the thesis is to evaluate the applicable legislation of diversions, furthemore to present various proposals de lege ferenda and to outline the presumed development of the legislation in the subject matter. The first part of the thesis introduces a general basis for the alternative way of dealing with criminal matters in the light of the internationally accepted concept of restorative justice. Secondly the thesis defines the individual charateristics of diversions and their purpose. Subsequently the thesis focuses on the individual types of diversions, namely conditional discontinuance of criminal prosecution, compensation, diversion aplicated in terms of the criminal procedings against juveniles, diversions aplicated in the preliminary proceedings, criminal order and the plea bargaining. Furthemore the thesis describes chosen foreign legal regulations of the subject of diversions, specifically the legal regulation of diversions in Austria and Slovakia. In conclusion the thesis processes statistical data of the aplication of diversions in Czech republic between the years 2012-2016 as well as the specific problems of the current legislation of diversions. Concurrently the thesis deals with the future legislation of diversions in particular connection to the recodification of the Criminal process code.
