Regulatory power of municipal government

Abstract:

Cílem bakalářské práce je seznámit čtenáře s problematikou vydávání právních předpisů na úrovni obecní samosprávy, jaké předpisy obce vydávají nejčastěji a jaký je jejich praktický význam pro obce. Nejdříve bude čtenář seznámen se základy územní samosprávy, s jejím postavením a posláním. Součástí bude i malý exkurz do nedávné historie obecní samosprávy. V další části budou představeny jednotlivé typy právních předpisů obcí a proces jejich projednávání, schvalování a publikace, včetně výkonu státního dozoru nad jejich vydáváním. Důležité je i seznámení s vývojem judikatury, v práci budou popsány nejzásadnější nálezy Ústavního soudu, které znamenaly zlom v nahlížení na možnosti obcí vydávat právní předpisy. Na závěr budou porovnány dvě konkrétní obce, s uvedením jaké obecně závazné vyhlášky a nařízení obce vydaly a nastíněny jejich zkušenosti a problémy související s daným tématem.

Abstract:

The aim of this bachelor’s thesis is to acquaint the reader with the issues of legal regulations issuance at the level of municipal self-government, kinds of regulations most frequently issued by municipalities and their practical meaning for municipalities. At first, the reader is presented with the basics of territorial self-government, its position and function. A small digression to the recent history of municipal self-government is included. In the following part there is a presentation of individual legal regulations of municipalities and the process whereby these are discussed, approved and published, including the implementation of state supervision over their issuance. A significance is given to the introduction to the development of judicature; the work includes an outline of such principal judgements of the Constitutional Court which meant the breakthrough in viewing what legal regulations may be issued by municipalities. In conclusion, two particular municipalities are compared, stating what by-laws and orders have been issued by the municipalities and their relevant experience and difficulties are outlined.
