Fruit of the Poisonous Tree Doctrine and Its Application by Czech Courts in the Criminal Proceeding

Abstract:

Diplomová práce se zabývá teorií plodů otráveného stromu a její aplikací v rámci trestního řízení před českými trestními soudy. Práce se blíže zaměřuje na charakteristiku zákonné úpravy neúčinných důkazů v trestním řízení a analýzu postoje českých soudů, a to zejména soudu Ústavního, a Evropského soudu pro lidská práva k teorii plodů otráveného stromu. Práce dále zdůrazňuje roli principu a testu proporcionality v rámci řešení konfliktu mezi individuálními zájmy obviněného na respektování jeho základních lidských práv a svobod a veřejným zájmem společnosti na potrestání pachatele trestného činu. Cílem práce je vymezit a kriticky zhodnotit aplikaci teorie plodů otráveného stromu zejména před českými trestními soudy a nastínit problematiku konfliktu zájmů vyvstávající při řešení přípustnosti důkazu.

Abstract:

The diploma thesis deals with the fruit of the poisonous tree doctrine and its application within the frame of criminal proceeding before Czech criminal courts. The thesis closely examines the characteristics of statutory regulation of ineffective evidence within the criminal proceeding and the analysis of the attitude of Czech courts, namely the Constitutional Court, and the European Court of Human Rights towards the fruit of the poisonous tree doctrine. The thesis further emphasises the role of the proportionality principle and the proportionality test in terms of resolving the conflict between the individual interests of the accused in respecting his basic human rights and freedoms and the public interest of the whole society in punishing the criminal offender. The aim of the thesis is to define and critically evaluate the application of the fruit of the poisonous tree doctrine namely by Czech criminal courts and to outline the problematics of the conflict of interests arising during the determination of the admissibility of evidence.
