The checs mark to identification of consumer package

Abstract:

ABSTRACT This thesis examines a trademark, which serves to protect the consumerist packages, especially the tobacco products and alcohol beverages. This is immediately connected with tax evasions, which in 99% of cases are linked with those products. A starting point for the thesis is the theoretical background of consumers right sphere, registered trademarks, excise tax and tax evasions. The first part of this thesis is the theoretical part. This part is divided into the three subheads. The second part of the thesis is created by the contemporary state analysis of tax evasions. (2007, 2008) The thesis deals with the period after the entrance of Slovakia into European Union and the straight impact of it onto the problematics of tax evasions. The second chapter of the thesis is divided into the two subheads. The suggestions and precautions which may be applicable in practice are described in the chapter three. This chapter includes informations acquired on the base of the theoretical and practical analyse which is described in the second chapter. The third chapter contains three subheads.

Abstract:

ABSTRAKT Diplomová práca je zameraná na skúmanie ochrannej známky, ktorá slúži na ochranu spotrebiteľského balenia pri tabakových výrobkoch ako aj pri liehu. S touto problematikou úzko súvisí problematika daňových únikov, ktoré sa v 99 % spájajú práve s už spomínanými tovarmi. Východiskom pre diplomovú prácu sú teoretické poznatky z oblasti ochrany spotrebiteľa, ochranných známok, spotrebných daní z tabakových výrokov a spotrebných daní z liehu a v neposlednom rade oblasť daňových únikov. Tieto poznatky sú spracované v prvej časti diplomovej práce, ktorá je obsiahnutá v troch podkapitolách. Druhá časť diplomovej práce pozostáva z analýzy súčastného stavu v oblasti uplatňovania ochrannej známky pri eliminácii daňových únikov. Daňové úniky sú skúmané za súčastné obdobie (roky 2007 a 2008) a rovnako diplomová práce je orientovaná aj na skúmanie vstupu SR do EÚ a vplyv tohto vstupu na vývoj daňových únikov. Druhá kapitola diplomovej práce je obsiahnutá v dvoch podkapitolách. Tretia časť diplomovej práce pozostáva z návrhov a opatrení, ktoré sa môžu uplatniť v praxi a zároveň môžu byť východiskom pre zmeny v legislatíve. Je zostavená na základe informácií získaných prostredníctvom teoretickej analýzy skúmanej problematiky ako aj praktickej analýzy prevedenej v druhej kapitole diplomovej práce. Tretia kapitola pozostáva z troch podkapitol.
