Abstract:
Práce je zaměřena na analýzu příčin a důsledků smluvní pokuty, jakožto utvrzovacího institutu. Jsou zde vymezeny její hlavní funkce a formální náležitosti. V práci je rovněž nastíněn historický vývoj smluvní pokuty na našem území až po současnost. Posuzuje vztah smluvní pokuty a jiných právních institutů. Bachelor thesis is focused on the analysis of the causes and consequences of liquidated damages. There are also defined its main functions and formal requirements. The thesis also outlines the historical development of the liquidated damages in our country up to the present. It considers the relationship between liquidated damages and other legal institutions.
