The Right to Strike of Employees of Business Entities

Abstract:

Bachelor thesis deals with legislative regulation of the right to strike of employees of business entities. After analysis of theoretical basis the bachelor thesis determines the value of the right to strike of the employees in the international context, compares it with other equivalents being used in different countries, describes its implementation in practice and its consequances. In the first chapter we deal with basic legal regulation and description of different forms of strike. In the second chapter we identify the right to strike in the international point of view and deal with its implementation in practice. In the third chapter we focus on the consequances of the participation on the strike and present the status of the right to strike using the concrete precedent.

Abstract:

Bakalárska práca sa zaoberá legislatívnou úpravou práva na štrajk zamestnancov podnikateľských subjektov. Na základe analýzy teoretických východísk tohto inštitútu determinuje jeho význam v medzinárodnom kontexte, porovnáva ho s obdobnými formami fungujúcimi v členských štátoch, opisuje jeho realizáciu v praxi a jej právne následky. V prvej kapitole sa zameriavame na základnú právnu úpravu a popis jednotlivých druhov a foriem štrajku. V druhej kapitole identifikujeme inštitút práva na štrajk na základe medzinárodnej analýzy a rozoberáme jeho realizáciu v praxi. V tretej kapitole sa zameriavame na dopad pracovnoprávnych a sociálnoprávnych aspektov na zamestnanca po účasti na štrajku a názorne vysvetľujeme postavenie práva na štrajk ako ústavou garantovaného práva na konkrétnom súdnom rozhodnutí.
