Abstract:

Transgender osoby odsouzené k trestu odnětí svobody jsou v České republice dosud na okraji zájmu odborné veřejnosti. Na základě zkušeností ze západních demokratických zemí lze oprávněně očekávat vzrůstající počet transgender osob ve věznicích České republiky, což bude vyžadovat připravenost Vězeňské služby. Problematika odsouzených transgender osob se z velké části dotýká transgender žen (male to female). Diplomová práce s využitím postupů kvalitativního výzkumu mapovala zahraniční zkušenosti zacházení s odsouzenými transgender ženami a zkoumala, jak se tyto zkušenosti projevují v České republice. Z analýzy zahraničních studií vyplynulo, že akcentovanými tématy ve vztahu k odsouzeným transgender ženám jsou umisťování, zajištění ochrany a bezpečnosti transgender žen v prostředí mužské věznice, možnost hormonální terapie a chirurgického zákroku vedoucího ke změně pohlaví během výkonu trestu a možnost vyjadřování ženskosti prostřednictvím oblečení, líčení apod. V případě umístění transgender žen do ženského vězení se jako klíčové jeví zabránění zneužívání „změny pohlaví“ a zajištění bezpečnosti odsouzených žen před transgender ženami. Analýza odborné literatury české provenience a relevantních dokumentů ČR ukazuje na absenci konkrétní vězeňské politiky reflektující zvláštní potřeby odsouzených transgender žen. Odsouzené transgender osoby jsou umísťovány do vězení na základě svého biologického matričního pohlaví, není umožněna hormonální léčba ani chirurgická operace v průběhu výkonu trestu odnětí svobody. Průzkumné šetření na malém vzorku (n=5) zaměstnanců mužských věznic naznačuje, že problematika odsouzených transgender osob není ve středu jejich zájmu. V českých věznicích nejsou organizována žádná speciální školení pro vězeňský personál zaměřená na problematiku. Názory odsouzené transgender ženy (umístěné v jedné z mužských věznic ČR) na umožnění změny pohlaví na základě prohlášení a na umístění na základě genderové identity, konvenují s praxí některých, zejména anglosaských zemí. Pozitivní zkušenosti této odsouzené transgender ženy s přístupem vězeňského personálu či s přístupem ke zdravotní péči a resocializačním programům neodpovídají poznatkům prezentovaným v zahraničních studiích.

Abstract:

Transgender persons sentenced to imprisonment are still on the fringes of the professional public's interest in the Czech Republic. Based on the experience of western democratic countries, we can legitimately expect an increasing number of transgender people in the prisons of the CR, which will require the readiness of the Prison Service. The issue of convicted transgender persons largely affects transgender women (male to female). The diploma thesis, using qualitative research procedures, mapped foreign experiences of the treatment of convicted transgender women and examined how these experiences are manifested in the Czech Republic. From the analysis of foreign studies, it emerged that the accented topics in relation to convicted transgender women are the placement, ensuring the protection and safety of transgender women in a male prison environment, the possibility of hormone therapy and surgery leading to sex change during the execution of the sentence, and the possibility of expressing femininity through clothing, make-up etc. In the case of placing transgender women in a women's prison, preventing the abuse of "gender change" and ensuring the safety of convicted women from transgender women appears to be key. The analysis of professional literature of Czech provenance and relevant documents of the Czech Republic shows the absence of a specific prison policy reflecting the special needs of convicted transgender women. Convicted transgender persons are placed in prison on the basis of their biological matrimonial sex, hormone treatment and surgery are not allowed while serving their prison sentence. An exploratory survey of a small sample (n=5) of male prison staff leaders indicates that the issue of convicted transgender persons is not at the center of their interest. In Czech prisons, there are no special training sessions for prison staff focused on the issue. The opinions of a convicted transgender woman (placed in one of the male prisons of the Czech Republic) on enabling sex change based on a declaration and on placement based on gender identity, conform to the practice of some, especially Anglo-Saxon countries. The positive experiences of this convicted transgender woman with the approach of prison staff or with access to health care and resocialization programs do not correspond to the findings presented in foreign studies.
