Special methods of proof

Abstract:

Předmětem této bakalářské práce je zachytit podstatu konkrétních zvláštních způsobů dokazování v rámci trestního řízení s tím, že vybrané aspekty ať již právního či kriminalistického charakteru jsou blíže zkoumány a podrobeny úvahám de lege ferenda, když se jejich aktuální aplikace autorovi jeví jako problematická či nedostatečná. Práce je koncipována do úvodní a obecné části, mající za cíl obecně důvodně představit konkrétní základy obecně pojímaných skutečností a právních principů zvláštních způsobů dokazování, které jsou obsaženy v první a druhé kapitole. Vlastní těžiště práce se nachází v kapitole třetí a v jejích podkapitolách, neboť zde jsou konkrétně uvedeny a představeny jednotlivé zvláštní způsoby dokazování a jsou podrobeny příslušnému zkoumání ze strany autora. Závěrem práce je pak zhodnocení průběžných zjištění a ad hoc uvedených úvah v rovině de lege lata versus de lege ferenda, jejichž úmyslem je vyvážení mezi legislativními požadavky a kriminalisticko-taktickou realizací.

Abstract:

The subject of this bachelor's thesis is to capture the essence of specific special methods of proof in criminal proceedings, with selected aspects, whether legal or criminalistic, being examined in more detail and subjected to de lege ferenda considerations when their actual application seems problematic or insufficient to the author. The thesis is conceived in an introductory and general part, aiming to reasonably introduce the specific foundations of generally conceived facts and legal principles of special methods of evidence, which are contained in the first and second chapter. The actual focus of the thesis is in chapter three and its subchapters, for here the various special methods of proof are specifically listed and introduced and are subjected to appropriate scrutiny by the author. The thesis concludes with an evaluation of interim findings and ad hoc considerations in terms of de lege lata versus de lege ferenda, the intention of which is to balance between legislative requirements and criminal-tactical implementation.
