Prevention and Solution of Overdure Debts

Abstract:

Bakalářská práce se zabývá prevencí a řešením pohledávek po splatnosti v podnikatelském prostředí. S problematikou nesplacených pohledávek se potýká celá řada podnikatelských subjektů při své podnikatelské činnosti. Tato práce systematicky shrnuje aktuální poznatky v oblasti prevence, zajištění, správy a vymáhání pohledávek. Vysvětluje základní pojmy: pohledávka, dlužník, věřitel, a popisuje vznik a zánik pohledávky. Bakalářská práce se zabývá významem zajišťovacích prostředků jak z hlediska prevence, kdy může věřitel předejít riziku nesplacení pohledávky, tak také jejich funkcí po splatnosti pohledávky. Aby podnikatelský subjekt zamezil nárůstu nesplacených pohledávek, musí se pohledávkami aktivně zabývat, tzn. musí pohledávky spravovat a následně vymáhat. Práce se zabývá způsoby vymáhání pohledávek – mimosoudním a soudním vymáháním. Dále porovnává řešení pohledávek přímo firmou – věřitelem (jeho oddělením pohledávek) nebo prostřednictví inkasní kanceláře. Je zde kladen důraz na efektivnost procesu správy a vymáhání. Prakticky orientovaný výstup bakalářské práce je zaměřen na prevenci a řešení pohledávek při exportu formou pojištění pohledávek, kdy pojištění je zároveň zajišťovacím a preventivním prostředkem.

Abstract:

This bachelor thesis deals with prevention and solution of overdue claims in entrepreneurial environment. There are a lot of enterprises facing the problem of outstanding debts. The aim of the thesis is to systematically sum up current knowledge in preventing, reinsurance, management, and collection of debts. It explains basic terms such as claim, debtor, creditor, and describes incurrence and extinction of claims. The bachelor thesis deals with the role of means of reinsurance from the point of view of prevention that can help creditor prevent the risk of their claims not being met, as well as from the point of view of their function after claim being due. In order to restrict the growth of outstanding debts, companies must deal with claims actively, i.e. they must manage and then recover claims, which will help to reduce the number of irrecoverable claims. The thesis also focuses on claims recovery – by the means of out-of-court and court settlement. It compares recovering of claims directly by creditor (by the company‘s claims department) or through a debt-collection agency. There is an emphasis on efficiency of management and debt collection. The practically oriented output of the bachelor thesis focuses on the prevention and solution of claims at export by insurance of claims, the insurance being both the means of claim reinsurance and prevention
