The Beginnings of International Political System in the Work of Hugo Grotius

Abstract:

Hugo Grotius byl významný autor a teoretik 17. století. Sepsal několik důležitých děl jako např. De Jure Belli ac Pacis nebo De Jure Praedae, jehož součástí je i kapitola Mare Liberum. Během jeho života Evropa prošla náboženskými válkami, které skončily až po jeho smrti, v roce 1648 Vestfálským mírem. Počátky Vestfálského systému můžeme pozorovat v Grotiovo Mare Liberum, kde zmiňuje suverenitu, která je základním kamenem tohoto systému. Cílem mé bakalářské práce bylo nalézt relevantní pojmy v Mare Liberum, které se týkají počátku mezinárodního politického řádu a jejich následná kvalitativní obsahová analýza. Mezi důležité termíny jsem zařadila státní suverenitu, državu, přirozené právo, právo vlastnit, právo plavby a právo obchodu. Jeho myšlenky hrály důležitou roli během koloniální éry, převážně úvahy o državě, protože Evropské mocnosti se staly koloniálními velmocemi v následujících stoletích. Na druhou stranu, v současné době můžeme vidět Grotiův odkaz v Úmluvě o mořském právu, která obsahuje jeho myšlenky ohledně práva plavby. Odkaz Huga Grotia je hlavně ve vytvoření mezinárodního práva jako samostatné vědní disciplíny. Věřil, že státy by měly mít stejná práva a měly by si být rovny, alespoň se takto vyjadřuje v kontextu Mare Liberum. Bez pochyb Grotia můžeme označit za otce mezinárodního práva. Státní suverenita hraje stále důležitou roli, hlavně v mezinárodních organizacích, kde státy participují na utváření mezinárodního politického řádu.

Abstract:

Hugo Grotius was a significant author and theorist in the 17th century. He wrote several works such as De Jure Belli ac Pacis or De Jure Praedae, whose part is a chapter Mare Liberum. During his life Europe went through religious wars, which ended after his death, in 1648, by Peace of Westphalia. We can see the origins of the Westphalian System in Grotius's Mare Liberum, where he mentioned state sovereignty, which is the cornerstone of the system. The object of my bachelor thesis was to find out relevant terms in Mare Liberum which relate to the beggings of the international political order and then analyze them with qualitative content analysis. Among the important terms I have classified state sovereignty, possession, natural right, right to own, right to sail and right to trade. The state sovereignty, which Grotius asserted, became the pedestal of Westphalian System. Another thing, which is important to mention, is that his thoughts played a substantive role during the colonial era, mainly his thought about possession, because European states became colonial empires in the following centuries. On the other hand, in today's world we can see the reflection of Hugo Grotius in United Nations Convention on the Law of the Sea which contains his thoughts of the right to sail. The legacy of Hugo Grotius is the separation of international right. He believed that states should have the same rights and should be equal in the context of Mare Liberem. With no doubts we can call him the father of international law. The state sovereignty is still important, mainly in the international organizations, where states participate in shaping international political order.
