Práce se zabývá detencí osob duševně nemocných ve smyslu čl. 5 odst. 1 písm. e) Úmluvy o ochraně lidských práv a základních svobod v České republice. Zodpovídá na otázku, v jakých zařízeních může k takovému omezení osobní svobody dojít, jaká je právní úprava těchto detencí a zejména, zda tato právní úprava umožňuje soulad s čl. 5 Úmluvy. The thesis deals with the detention of mentally ill persons in the sense of Art. 5-1-e of the European Convention on Human Rights in the Czech republic. It answers following questions: in which facilities can such a detention take place; what is the legislation regulating detentions; and especially whether the legislation enables compliance with Art. 5 of the European Convention.
