Inadmissibility and unacceptability of the cassation complaint

Abstract:

Diplomová práce se zaměřuje na institut kasační stížnosti jakožto mimořádného opravného prostředku ve správním soudnictví, zejména pak na její nepřípustnost a nepřijatelnost. Cílem analyzování jak kasační stížnosti, tak těchto aspektů. Práce je rozdělena do tří částí. První kapitola obsahuje historické důvody, které vedly k zavedení kasační stížnosti a obecnou charakteristiku tohoto mimořádného opravného prostředku. Druhá kapitola popisuje přípustnost kasační stížnosti, stížní důvody. Dále je obsahem druhé kapitoly nepřípustnost kasační stížnosti jak v obecné rovině, tak ve vztahu ke konkrétním důvodům, jak je uvádí SŘS se zaměřením na analyzování těchto důvodu. Třetí kapitola tvoří deskripce nepřijatelnosti kasační stížnosti, změn a modifikací normativního textu upravujícího tento institut a závěr tvoří rozbor současného znění.

Abstract:

The thesis focuses on the institution of the cassation complaint as an extraordinary remedy in administrative justice, in particular on its inadmissibility and unacceptability. The aim of analysing both the cassation complaint and the following aspects. The work is divided into three parts. The first chapter contains the historical reasons that led to the introduction of the cassation complaint and a general characterization of this extraordinary remedy. The second chapter describes the admissibility of a cassation complaint, the grounds of complaint. The second chapter then examines the inadmissibility of the appeal, both in general terms and in relation to the specific grounds as set out in the Administrative Procedure Code, with a focus on analysing those grounds. The third chapter consists of a description of the unacceptability of a cassation complaint, changes and modifications to the normative text governing this institution and concludes with an analysis of the current wording.
