The interrogation of extremely vulnerable victim

Abstract:

Diplomová práce je zaměřena na výslech zvlášť zranitelné oběti – dítěte. V jednotlivých částech je popsána problematika výslechu z pohledu právního, kriminalistického a psychologického. Samostatná část je věnována výslechu jakožto sociální interakci s ohledem na zvláštnost dítěte, coby hlavního aktéra výslechu. Dále je uvedena právní úprava výslechu dítěte, včetně specifik samotného výslechu a konkrétních případů. Na toto téma volně navazuje i problematika vnějších okolností výslechu, jako jsou prostory, využívané pomůcky a tak podobně. Pro srovnání s jinými zeměmi Evropské unie je v diplomové práci uvedena i německá právní úprava trestných činů proti lidské důstojnosti v oblasti sexuální a proti rodině a dětem páchaných na dětech. Závěr diplomové práce tvoří výzkumná část, která prostřednictvím kazuistik analyzuje vybrané případy trestných činů páchaných na dětech. Cílem diplomové práce je zhodnotit "de lege lata", tedy současnou právní úpravu výslechu dítěte, metody výslechu z pohledu příslušníka Policie České republiky a zároveň ve smyslu úvahy "de lege ferenda" vyhodnotit společenskou škodlivost vybraných trestných činů a navrhnout případnou změnu právní úpravy.

Abstract:

Thediploma thesis focuses on theinterrogationof a particularlyvulnerablevictim - a child. In various parts of the examination are described problems in terms of legal, investigative and psychological. A separate part is devoted to interrogation as a social interaction with regard to the specific child as the main actor of interrogation. There is the legal regulation of the interrogatin of the child, including the specifics of the interrogation itself and specific cases. This issue follows on from the matter of external circumstances of interrogation, such as premises, utilities etc. Compared to other countries of the European Union, the diploma thesis deals with the German legal regulation of crimes against human dignity in the field of sexual, crimes against family and crimes against children. The conclusion of the diploma thesis is a research part, which analyzes cases of crimes committed against children by way of case interpretation. The aim of the diploma thesis is to evaluate "de lege lata", the current legal regulation of child interrogation, the method of interrogation from the point of view of a member of the Police of the Czech Republic and, in the meaning of the de lege ferenda, to assess the societal harmfulness of selected crimes and propound a possible change in the law.
