Cancellation and settlement of co-ownership

Abstract:

Diplomová práce je zaměřena na zrušení a vypořádání podílového spoluvlastnictví. Cílem práce je analyzovat případy, kdy se jeden ze spoluvlastníků rozhodne ze vztahu odejít. Práce se skládá z úvodu, sedmi částí a závěru. V první části se autor věnuje základní charakteristice podílového spoluvlastnictví, vybraných základních prvků tohoto institutu, jako jsou například předmět nebo spoluvlastnický podíl. Následně je práce zaměřena již na samotné zrušení a vypořádání spoluvlastnictví, v tomto ohledu je rozdělena na podkapitoly, a to dle způsobů zrušení a vypořádání. Do samostatného oddílu je také zařazen poměrně nový právní institut, a to oddělení ze spoluvlastnictví. V závěru práce autor přidává komparaci se zahraniční, a sice německou právní úpravou, která je dle jeho názoru nejbližší naší tuzemské úpravě. Autor se dále pokouší přidat vlastní úvahy na rozebíranou problematiku včetně zhodnocení právní úpravy.

Abstract:

The diploma thesis focuses on the cancellation and settlement of co-ownership. The aim of the thesis is to analyse cases when one of the co-owners decides to leave the relationship. The thesis consists of an introduction, 7 parts and a conclusion. In the first part, the author discusses the basic characteristics of co-ownership, selected basic elements of this institute, such as the subject or co-ownership share. Subsequently, the thesis focuses on the cancellation and settlement of co-ownership itself, the thesis is divided into subchapters in this respect, according to the methods of cancellation and settlement. A relatively new legal institution, namely the separation from co-ownership, is also included in a separate chapter. At the end of the work, the author makes a comparison with foreign, namely German legislation, which, in the author's opinion, is the closest to our domestic legislation. The author also attempts to add his own reflections on the issue under discussion, including an evaluation of the legal regulation.
