Abstract:

Fenomén margin of appreciation představuje jeden z klíčových elementů používaných v rámci interpretace a aplikace Evropské úmluvy o lidských právech. Slouží, nejobecněji řečeno, k vymezování optimálního vztahu mezi (1) relativní diskrecí, kterou vnitrostátní orgány požívají při omezování práv zaručených Úmluvou, popř. v rámci plnění svých pozitivních povinností při jejich efektivním prosazování, a (2) intenzitou kontrolní činnosti Soudu. Výchozím bodem disertace je pohled na dva odlišné právněfilozofické náhledy na opodstatněnost a používání doktríny jako takové: konzervativní a progresivní. Zatímco první z nich klade důraz na relativní volnost smluvních stran při aplikaci Úmluvy a na sebeomezení Soudu, druhý z nich naopak vyzdvihuje nezávislou roli tohoto orgánu, jehož posláním je vytváření celoevropských standardů ochrany lidských práv a striktní ochrana jednotlivce. Bližší pohled na to, jak se tato dvě paradigmata projevují v praktické aplikaci doktríny margin of appreciation, je jádrem druhé, analytické části. Její nosnou rovinou je systematická analýza nejdůležitějších oblastí, v nichž řečená doktrína dochází svého uplatnění. Třetí, závěrečná kapitola podává syntetické shrnutí faktorů, jež ovlivňují intenzitu kontrolní činosti Soudu a skrze ni i parametry národní diskrece. Celá práce je ukončena pohledem na uplatnění doktríny margin of appreciation v rámci základních interpretačních metod Úmluvy.

Abstract:

The phenomenon of margin of appreciation represents one of the key elements in the interpretation and application of the European Convention on Human Rights. It serves, broadly speaking, to establish a proper relationship between (1) a relative discretion that the Contracting States enjoy in restricting the rights under the Convention or, alternatively, in discharging their positive obligations under that instrument, and (2) the intensity of the scrutiny of the Court. The dissertation proceeds from an analytical discussion of two conflicting approaches to the merits and modes of operation of the doctrine: the conservative and the progressive one. While the former lays emphasis on a relative discretion of the Contracting States when interpreting the Convention and on the self-restraint of the Court, the latter stresses the independent nature of this organ whose function is the development of European-wide standards of human rights protection and a strict protection of the individual. A closer look on the way the two paradigms manifest themselves in the practical operation of the margin of appreciation doctrine is the core of the second, analytical part. Its basis consists in a systematic analysis of the most important areas where the doctrine has been used predominantly. Finally, the third chapter offers a synthetic perspective on the factors that influence the intensity of the scrutiny of the Court and, consequently, the parameters of the national discretion. The study is concluded with an account of how the doctrine operates within the chief interpretative methods of the Convention.
