Problems of a Business Name as a Right to Designate

Abstract:

Diplomová práce se zabývá problematikou obchodní firmy v kontextu jejího zařazení mezi práva na označení. Úvodní kapitola je věnována pojmu obchodní firmy, jejím funkcím a zásadám. Následuje kapitola zabývající se konkrétními problémy obchodní firmy v souvislosti její úpravy v novém občanském zákoníku. Zbytek práce pojednává o kolizi obchodní firmy s ochrannou známkou, tedy konkrétním problému, jehož zákonný režim lze nalézt jak v novém občanském zákoníku, tak v zákoně o ochranných známkách. Práce klade důraz také na novelu známkového zákona a návrhy řešení de lege ferenda.

Abstract:

The diploma thesis deals with the issue of a business name in the context of its classification as a right to designation. The introductory chapter is devoted to the concept of business name, its functions and principles. The following is a chapter dealing with the particular problems of the business name in the context of its regulation in the new Civil Code. The rest of the work deals with the collision of a business name with a trademark, a specific problem whose legal regulation can be found both in the new Civil Code and in the Trade Marks Act. The thesis also emphasizes the amend-ment to the trademark law and the proposed solutions de lege ferenda.
