Abstract:

Vklad do katastru nemovitostí je jeden ze tří druhů zápisů, které se zapisují do katastru nemovitostí. Pilířem tohoto zápisu je zásada intabulace, která představuje právotvorný princip. Právní účinky vkladu vznikají na základě pravomocného rozhodnutí o jeho povolení ke dni, kdy návrh na vklad byl doručen katastrálnímu úřadu. V mé práci jsem se snažila přiblížit postup katastrálního úřadu se kterým souvisí vklad do katastru nemovitostí, a to s vadami tohoto právního úkonu , kdy správní orgán je povinen vyzvat účastníky řízení - ať již výzvou k odstranění nedostatků návrhu, přerušením vkladového řízení, zastavením vkladového řízení - až po zamítnutí vkladového řízení.

Abstract:

Entry in the cadastre of real estates is one of the free types of records in the cadastre of real estates. The most important is a intabulation principle which means that property rights to real estates are created by registering in the cadastre of real estates with legal effect on the date of application for entry. In my bachelor thesis there is especially described proceeding of cadastral office when there are some defects in the deed. Cadastral office may use all the procedure decisions provided by Act No. 500/2004 Coll., on Administrative Procedure (Procedure order), like stay of proceedings stay or discontinuance of proceedings. Cadastral office can also reject the entry to the cadastre of real estates if the defects don´t let cadastral office to decide on permitting entry.
