Vietnamese in the Pilsen region in connection with the debt abys.

Abstract:

Tato bakalářská práce je zaměřena na téma "dluhová past a exekuce v souvislosti s vietnamskou komunitou působící v západních Čechách". V úvodu této práce jsem si položila pár otázek. Dokáží se Vietnamci orientovat v české legislativě? Lze jazykovou bariérou odůvodnit poměrně častý výskyt exekučních řízení vedených na majetek Vietnamců? Nebo spočívají tyto příčiny v jiných okolnostech? Nejprve jsem analyzovala historické důvody příchodu Vietnamců do ČR a dále jsem se soustředila na nejčastější příčiny těchto příchodů. Pomineme-li důvody způsobené studenou válkou, pak se Vietnamci nejčastěji stěhují do České republiky kvůli finančním možnostem, které jim Česká republika nabízí. Jednou z nejvíce prospěšných kapitol v této bakalářské práci je kapitola popisující dluhovou past a exekuční řízení v České republice i ve Vietnamu. Zde mohu říci, že exekuční řízení ve Vietnamu jsou prováděny podobným způsobem jako v České republice, což bylo pro mě velkým překvapením, ale zároveň velkým přínosem. Tato práce pracuje s informacemi, které byly získány v terénních výzkumech s odborníky z různých oblastí a také s Vietnamci. Zjistila jsem, že nejvíce jsou postiženi exekucemi vietnamští muži. V kvalitativní části práce jsem se snažila získat relevantní informace od Vietnamců a také zástupců věřitelů, kterým Vietnamci dle kvantitativní části této práce nejčastěji dluží. Z rozhovorů s Vietnamci vyplynulo, že přišli do České republiky s myšlenkou zlepšení jejich životní situace. Vietnamci potvrdili neznalost českých zákonů, což je dle jejich slov způsobeno složitostí právních předpisů a omezenými znalostmi Českého jazyka. Podle jejich názoru, zdravotní pojištění a zdravotní péče jsou v České republice příliš drahé. Z tohoto důvodu jsou pro cizince (nejen Vietnamce) dluhy vůči zdravotním pojišťovnám nejběžnější. Při zpracování této práce jsem získala mnoho informací o dluzích Vietnamců, žijících v České republice a jejich exekučním vymáhání. Zkoumané téma mě natolik zaujalo, že se mu budu ráda věnovat i v budoucnu, například v mé diplomové práci.

Abstract:

This bachelor thesis is focused on the topic "Debt trap and distraint in connection with Vietnamese community in Western Bohemia". In the introduction of this bachelor thesis I asked myself a few questions. Is Vietnamese community able to orientate in Czech legislation? Is it possible to justify a relatively common occurrence of enforcement proceeding against the property of Vietnamese by a language barrier? Or can we look for the cause in other circumstance Firstly, I have to analyse historical reasons of the arrival of Vietnamese to the Czech Republic and I have to focus on the most common causes of these arrivals. Besides the reasons caused by the Cold War, the main purpose of Vietnamese displacement to the Czech Republic are the financial opportunities, which are offered by the Czech Republic. One of the most beneficial chapters in this bachelor thesis is the chapter describing the debt trap and distraints in the Czech Republic and also in Vietnam. Here I can say that the distraints in Vietnam are conducted in a similar manner like in the Czech Republic, which was huge surprise, but also useful for me. This thesis works with information, which was acquired due to the field researches with experts from the different areas and also with Vietnamese. I found, due to the research in the Distraint offices, that Vietnamese men are most affected by the distraints. In qualitative part of this thesis I try to obtain relevant information from Vietnamese and also from creditors' representatives, to whom Vietnamese mostly owe according to the results of quantitative part of this thesis. Interviews with Vietnamese show that they arrived to the Czech Republic with an idea of improvement of their life situation. Vietnamese confirm ignorance of the law, which is caused by a complexity of legislation and limited knowledge of the Czech language. According to their opinion, health insurance and health care are too expensive in the Czech Republic. Due to this reason, the debts towards health insurance companies are most common for foreigners (not only Vietnamese). During preparation of this thesis I obtained a large amount of information about the debts of Vietnamese, who are living in the Czech Republic, and about connected distraint enforcement. The researched theme impressed me so much that I will deal with it also in the future, for example in my master thesis.
