Termination of employment on the basis of unilateral legal proceedings

Abstract:

Diplomová práce se zabývá rozvázáním pracovního poměru na základě jednostranných právních jednání s důrazem na ochranu zaměstnance, jakožto slabší strany pracovněprávního vztahu. Cílem diplomové práce je, na základě analýzy jednotlivých způsobů skončení pracovního poměru a v kontextu pramenů pracovního práva, zhodnotit postavení zaměstnance v této oblasti. Z praktického hlediska je poukázáno na případy jednotlivých způsobů skončení pracovního poměru s uvedením relevantních vzorů právních dokumentů a doporučeného postupu řešení.

Abstract:

The thesis deals with the termination of employment on the basis of unilateral legal proceedings, with an emphasis on the protection of the employee, as the weaker party in the employment relationship. The aim of the thesis is to evaluate the status of the employee in this area on the basis of an analysis of the different methods of termination of employment in the context of sources of labour law. In practical terms, reference is made to the cases of individual termination procedures, indicating the relevant models of legal documents and the recommended resolution procedure.
