Land Register Principles with Focus on the "Good Fith" Principle

Abstract:

Tato práce se zabývá zásadami katastru nemovitostí se zaměřením na zásadu dobré víry. Cílem je objasnění zásady dobré víry, která je v současné době pouze částečně uplatňována. Tato zásada slouží k ochraně osob nabývajících vlastnické právo k nemovitosti v dobré víře, že zapsaný stav v katastru nemovitostí souhlasí se stavem skutečným. Nedostatečná dobrá víra v katastru nemovitostí může vést k ohrožení nabytých vlastnických práv a tím přímo k ohrožení ústavně zaručeného práva na pokojné užívání majetku. V souvislosti s tím, uvádí práce několik soudních rozhodnutí, které se této zásady týkají a na jejichž základě je provedeno právní zhodnocení této zásady. Řešením současné situace by měl být nový občanský zákoník a nový katastrální zákon, ve kterých bude tato zásada plně uplatňována. Změnám, které tyto dva zákony přinesou, je věnována závěrečná část práce.

Abstract:

This thesis is concerned with the principles of land register with focus on the principle of good faith. The aim is to clarify the principle of good faith, which is recently applied only partially. This principle protects a person acquiring the ownership of realty in good faith that the situation registered in land register is in accordance with the real situation. Insufficient good faith in land register might threaten acquired ownership rights and in therefore threaten constitutionally guaranteed right to peaceful enjoyment of property. The thesis presents a legal assessment of the good faith principle based on few judicial decisions concerning this principle. A new civil code and a new cadastral law fully applying good faith principle should be a solution to the current situation. The last part of the thesis is concerned with the changes brought by these new laws.
