Trademarks and Their Legal Protection

Abstract:

Anotace Ochranné známky jsou naší každodenní nedílnou součástí a spadají do našeho běžného života. Při koupi určitého sortimentu zboží, spotřebitel drží v rukou určitou značku výrobku, aniž by si byl vědom toho, že mohou být jednotlivě registrovány ochrannou známkou a co vše je chráněno právem a zákonem. Jednou z podstatných náležitostí ochranných známek by měla být jejich záruka dobrého jména podniku pro společnost a tím zamezení plagiátorství. Světové firmy proto vynakládají mnoho finančních prostředků dosahujících několika miliard korun, aby se právě svou ochrannou známkou a licencemi zviditelnily a zajistili si jedinečnou technologii výrobků a ostatním soutěžícím tím zamezili parazitovat a zneužívat jejich dobrého jména. V případě, že si spotřebitel vědomě kupuje levný výrobek s napodobeninou loga světoznámých firem, nemůže očekávat stejnou kvalitu výrobku, a to se nakonec může ukázat, jako neefektivní. České zákonodárství, chrání majitele ochranné známky obchodním zákoníkem proti nekalé soutěži, spolu s právem ochranné známky, jež upravuje všechny náležitosti týkající se jejího vydání. Tím se výrobce zavazuje plnit potřeby a přání jednotlivého zákazníka. V České republice se nejlépe umístila za rok 2010 firma ,,ČEZ“ a ,,Škoda auto“.

Abstract:

Annotation which may eventually prove as inefficient. Trade marks are integral part of our everyday life and belong there. If a consumer buys certain merchandise, he/she holds in hand a certain product trademark without being aware that such product may be registered with a trademark and thus protected by law. One of substantial appurtenances of trademarks is their guarantee of good company name which prevents plagiarism. World companies therefore expend considerable funds amounting up to several billion crowns to make them visible through their trademark and licences, which would ensure unique technology of products to them, and prevent other competitors from parasiting and misusing the good names of those companies. If the consumer intentionally buys a cheap product imitating a logo of world known companies, he/she cannot expect the same quality of the product The Czech legislation protects trademark owners against unfair competition by Commercial Code, along with the trademark copyright which adjusts all the appurtenances applicable to its release. Thus the manufacturer undertakes to fulfil the needs and wishes of individual customer. The best positions in the Czech Republic for 2010 were taken by the companies “ČEZ” and "Škoda auto“.
