The analysis of judicial decisionmaking in child custody proceedings

Abstract:

Bakalářská práce se zabývá problematikou rozdílů v názorech opatrovnických soudců o svěření dětí do péče. Teoretická část charakterizuje rodinné prostředí, soudní proces ve věcech péče o nezletilé a jaké formy svěření péče o děti může soud uložit. Dále se zabývá charakteristikou osobnosti soudce a prostředky, jaké soudce volí při svém rozhodování. Výsledky uskutečněného výzkumného dotazníkového šetření, závěry a doporučení využitelná v praxi sociální pedagogiky a dalších disciplín tzv. pomáhajících profesí tvoří empirickou část. Cílem bakalářské práce bylo najít rozdíly mezi dvěma skupinami respondentů, opatrovnických soudů s délkou praxe delší jak 10 let a soudců, kteří vykonávají funkci soudce kratší dobu, v rozhodování o svěření dětí do péče. Pro statistické vyhodnocení dat získaných z dotazníkového šetření bylo využito příslušného typu t-testu pro komparaci aritmetických průměrů dvou nezávislých výběrů dat a pro rozbor nominálních dat byla využita metoda chí-kvadrát test nezávislosti.

Abstract:

The bachelor's thesis deals with the issue of differences in the opinions of guardianship judges on the entrustment of children to care. The theoretical part characterizes the family environment, the court process in matters of care for minors and what forms of custody of children can be imposed by the court. It also deals with the characteristics of the judge's personality and the means that the judge chooses in his decision-making. The results of the research questionnaire survey, conclusions and recommendations usable in the practice of social pedagogy and other disciplines of the so-called helping professions form the empirical part. The aim of the bachelor's thesis was to find differences between two groups of respondents, guardianship courts with more than 10 years of experience and judges who hold the position of judge for a shorter period of time in deciding on the placement of children in care. For statistical evaluation of data obtained from the questionnaire survey, the appropriate type of t-test was used to compare the arithmetic means of two independent data selections and for the analysis of nominal data, the chi-square test of independence was used.
