Investigation of frauds with financial interest of the European union

Abstract:

Tato disertační práce vychází z předpokladu, že finanční zájmy EU nejsou za současného stavu dostatečně chráněny před sofistikovanou trestnou činností. Práce podává ucelený přehled o vývoji myšlenky ochrany finančních zájmů EU, nastiňuje dosavadní vývoj trestního práva EU, včetně predikce budoucích perspektiv, dále reflektuje otázky stran institucionálního rámce pro vyšetřování a stíhání, resp. pro mezinárodní justiční spolupráci v trestních věcech v dané oblasti, a předkládá nové formy harmonizačních opatření na poli trestního práva. Stávající unijní instituce a agentury typu Eurojust, Europol a OLAF mají při vyšetřování podvodů s finančními zájmy EU limitované pravomoci, které by měly být do budoucna vyřešeny zřízením nové instituce v podobě Úřadu evropského veřejného žalobce. V rámci disertační práce je tudíž hodnoceno, zda má tento nový úřad potenciál přispět k efektivnější ochraně finančních zájmů EU, a dále jsou navrženy alternativy, které by účinnější ochraně těchto finančních zájmů měly napomoci, avšak se zřízením Úřadu evropského veřejného žalobce nepočítají.

Abstract:

This dissertation is based on the assumption that the EU’s financial interests are not sufficiently protected against sophisticated crime at the present stage. Dissertation gives a comprehensive overview of the evolution of the idea of protecting the EU’s financial interests, outlines the current development of EU criminal law, including the prediction of future perspectives, further reflects questions about the institutional framework for the investigation and prosecution, respectively for the international judicial cooperation in criminal matters in the objective area, and suggests new forms of harmonization measures in the field of criminal law. Current EU institutions and agencies such as Eurojust, Europol and OLAF have limited powers as to the investigation of frauds with EU’s financial interests that should be resolved by establishing a new institution in the form of a European Public Prosecutor’s Office. In the context of the dissertation it is therefore assessed whether this new Office has potential to contribute to more effective protection of the EU’s financial interests, as well as there are designed alternatives that should help to more effective protection of these interests, but do not count with the establishment of the European Public Prosecutor’s Office.
