The landed property and the nature protection

Abstract:

Cílem této práce je popis a zhodnocení vztahu pozemkového vlastnictví a ochrany životního prostedí. Pda jakožto pedmt pozemkového vlastnictví se je úzce spojena s okolním prostedím, stává se tedy akním polem lidské innosti a proto i pírodním zdrojem potenciáln snadno znehodnotitelným. Aktuálním problémem, který je pedmtem zvýšeného zájmu nejen našich, ale i evropských institucí, je problematika degradace pd, a to pevážn v dsledku nevhodných aktivit lovka. Dalším problémem, kterým je nutno se zabývat, je trvalý úbytek pd a s ním spojené zmny pdního fondu a šíení zastavných ploch. Prostor volné krajiny bývá azen mezi neobnovitelné pírodní zdroje urující kvalitu života, proto je nutná ochrana tohoto zdroje a všeho, co s tím souvisí. Posuzováním vliv na životní prostedí a veejné zdraví, což souvisí úzce s ochranou pírody, se zabývá zák. . 100/2001 Sb. (zákon o posuzování vliv na životní prostedí) ve znní pozdjších pedpis, podle kterého se posuzují vlivy na veejné zdraví a vlivy na životní prostedí zahrnující vlivy na živoichy a rostliny, ekosystémy, pdu, horninové prostedí, vodu, ovzduší, klima a krajinu, pírodní zdroje, hmotný majetek a kulturní památky a na jejich vzájemné psobení a souvislosti. Právní charakter pdy byl vymezen již v r. 1654, kdy vznikla 1. berní rula neboli 1. rustikální katastr. Stalo se tak po ticetileté válce, kdy zstalo v echách i na Morav množství opuštných a vyhoelých usedlostí, které si šlechta rozebírala a nastala tak poteba evidence a kontroly pdy a pozemk. Touto rulou byl vymezen právní charakter pdy: pda jednou zapsaná v berní rule (nebo v jejím nástupci) byla nadále nesvobodná, zdanitelná a nemohla být z evidence vyata jinak než koupí a patiným daovým odvodem ve prospch státu. Evidence pozemk a s nimi spojeného vlastnictví je v souasné dob v kompetenci katastrálních úad , které vykonávají státní správu katastru nemovitostí eské republiky, a to dle zákona . 359/1992 Sb, o zemmických a katastrálních orgánech ve znní pozdjších pedpis .

Abstract:

The estate property and nature protection. The basic source of legal amendment about the nature protection is Act of the land and nature protection no. 114/1992 of the statute book. This act comprises even the institutes of property rights system, but not in a complex way. Then it is necessary to proceed from the general civil law in the Code of Civic Law or from other law precepts closely connected with the Act of the land and nature protection. In my opinion, the law precepts of estate property, the estate property and the nature protection themselves are directly related to the act which is also the aim of my thesis relation between the estate property and the nature protection. The basic law frame has been set up in the field of the protection of land and nature. It has been integrated into the European context, but there is still scheme NATURA 2000 to finish. The land generally is not a real object of interest for the estate property but it is its concrete part grounds, actually a plot of ground which is individually limited and is not substitutable. The legal terms of grounds and the plot of ground are in the present law defined only in Act of cadastre of real estates in the Czech Republic no. 344/1992 of the statute book (the cadastral act). The land is divided into agricultural suitable for farming, non-agricultural unsuitable for farming because of its composition, and the land used for non-agricultural purposes forests, water areas, built-up sites and courtyards and others. The sum of agricultural and non-agricultural land in the state forms the state land resources. After 1990 there was a change in the attitude to the agriculture and land the reintroduction of private property. First ideas after 1990 presumed that a part of the land would be used for land precautions. There have appeared new forms of recreation in the country besides the traditional ones (cottages, weekend houses, hiking). The example can be large golf courses realization of which used to be almost impossible in the past. The shaping of the landscape is essentially influenced by the building of transport and technical infrastructure which looks as a barrier in the country, contributes to the next fragmentation of the land and influences landscape character. The Czech Republic is located in the centre of Europe which causes the pressure to build new highway and railway routes. The land and nature protection is also one of the factors influencing the landscape shaping. The relevance of the relation between the law amendment of the land and nature protection and the estate property is above all in the fact that the quality of the environment is based on each particular plot of ground owner and their direct impact on it caused by realization of the owners property rights.
