Trading in the EU in terms of VAT

Abstract:

Diplomová práce se zabývá obchodováním v Unii z pohledu DPH. Jejím hlavním cílem je definovat specifika vznikající při aplikaci zákona o DPH pro oblast vzájemného obchodního styku v EU. Teoretická část představuje daň z přidané hodnoty a její legislativní úpravu z různých úhlů pohledu. Vymezuje také podmínky pro obchodování v rámci Evropské unie a se třetími zeměmi. V praktické části jsou analyzovány významné novely českého zákona o DPH a jejich dopady pro obchodování. Z této analýzy následně vyplývají tři důležitá specifika. První z nich se projevilo v posledních několika letech. Jde o zvyšování sazeb DPH. Druhý je princip reverse-charge zaváděný do zákona o dani z přidané hodnoty hlavně kvůli zamezení daňovým únikům. Posledním specifikem je celkové zpřísňování zákona. Provádí se proto, aby systém lépe fungoval a byl transparentnější. Prioritou je opět také zabraňování daňové trestné činnosti. Zkoumána byla také Zelená kniha o budoucnosti DPH. Tento dokument dal impuls k diskusi nad nutností provedení komplexní reformy současného systému daně z přidané hodnoty. V následném sdělení Evropské komise se objevila vize se třemi hlavními cíli, které by měly k reformě napomoci. Dá se říci, že stávající systém DPH v Evropské unii je už poměrně zastaralý. Jeho největším problémem jsou aktuálně daňové podvody a také složitá a nejednoznačná právní úprava. Snahy o jeho reformování jsou správnou cestou pro jeho lepší fungování a další vývoj.

Abstract:

This thesis deals with trading in the EU in terms of VAT. Its main aim is to define the specifics arising at the application of the Law on VAT for the mutual trade in the EU. The theoretical part shows the value added tax legislation and its treatment from different angles. It also outlines the conditions for trade within the European Union and whit third countries. In the practical part analyzes significant amendment to the Czech Law on VAT and their implications for business. From this analysis, then follow three important specifics. The first one showed in the last few years. It is the increase in VAT rates. The second is the principle of reverse-charge introduced into the Law on Value Added Tax due mainly to avoid tax evasion. The last specific is of the overall tightening of the law. Is performed so that the system work better and more transparent. The priority is, once again, preventing tax crime. Also researched was the Green Paper on the future of VAT. This document gave impulse to the debate over the need to implement a comprehensive reform of the current system of value added tax. In a subsequent communication from the European Commission an vision is appeared with three main objectives, which should help to reform. We can say that the current VAT system in the European Union is already quite obsolete. His biggest problem is the current tax fraud as well as complicated and ambiguous legislation. Attempts to reform are the right way for its better functioning and further development.
