Interrogation

Abstract:

Bakalářská práce je zaměřena na téma výslechu osob. Popisuje stručný průřez historií vyslýchání a vysvětluje základní definici a hlavní úlohu výslechu, jako zdroje informací důležitých především pro účely trestního řízení, ale rovněž jako důležitou metodu dokazování v přestupkovém řízení. Vyjmenovává a definuje druhy výslechů osob podle jejich postavení v různých fázích, tedy v přípravném a v zahájeném řízení. Jedná se konkrétně o výslech podezřelé osoby, obviněné osoby, výslech svědka, poškozeného či výslech znalce. Práce shrnuje, jaké osoby mohou být podrobeny výslechu s ohledem na jejich věk, psychický stav či zdravotní stav a zároveň charakterizuje odborné předpoklady, které by měla mít vyslýchající osoba. Tato bakalářská práce je zaměřena na zachovávání náležitého postupu a podmínek výslechu, prováděného pověřenými osobami z řad policistů a úředníků správních orgánů.

Abstract:

The bachelor thesis is focused on the topic of persons´ interrogation. It describes a brief cross-section of the history of interrogation and explains the basic definition and the main role of interrogation as a source of information important especially for the purposes of criminal proceedings, but also as an important method of proving in offense proceedings. It lists and defines the types of persons´ interrogation according to their status at various stages, ie in the preparatory and initiated proceedings. Specifically, the interrogation of the suspect, accused person, witness, victim or expert. The thesis summarizes what kind of persons can be interrogated with respect to their age, mental state or health state and at the same time characterizes the professional prerequisites that the interviewer should have. This bachelor thesis is focused on maintaining the proper procedure and conditions of interrogation, carried out by authorized persons from the ranks of police officers and administrative authority officials.
