Temporary agency work on the EU internal market

Abstract:

Tato diplomová práce je zaměřena na agenturní zaměstnávání v podmínkách vnitřního trhu EU. Cílem práce je poskytnout pomocí analýzy přehled aspektů agenturního zaměstnávání v členských zemích EU, a také rozdíly mezi nimi. Práce je rozdělena na dvě části, z čehož první část poskytuje terminologický podklad a výčet právních norem důležitých pro zpracování druhé, praktické části. V praktické části jsou s ohledem na hypotézu práce analyzovány: vývoj a zlomové momenty týkající se agenturního zaměstnávání, současné unijní a národní předpisy a s nimi související omezení (existují-li), vztahy mezi počty agenturních zaměstnanců a HDP či také další statistické údaje relevantní pro agenturní zaměstnávání v EU. Přeshraniční dimenze agenturního zaměstnávání, jež nesmí v souvislosti se současnou diskuzí mezi původními a novými státy EU být opomenuta, vstupuje do jednotlivých kapitol v rámci celé praktické části práce. Toto téma se přímo dotýká oblastí, jako jsou pracovní právo či sociální zabezpečení, které jsou sice součástí sociální politiky EU, ale pravomoci v této oblasti jsou především v rukou členských států. EU v této oblasti ale může působit jako partner všech zainteresovaných stran a nastavit tak společné cíle, jako je například novelizace směrnice o vysílání pracovníků. Tato novelizace je odpovědí na sociální dumping, který vzniká v souvislosti s přeshraničním zaměstnáváním, a to nejen v případě TAW. V praxi se totiž často stává, že pracovník vyslaný z východu na západ pobírá mzdu odpovídající zemi, ve které je zaměstnán, ne té, do které je vyslán. Otázkou však zůstává, do jaké míry budounová nastavení v regulaci ochotné akceptovat východní státy, jejichž pracovníci nyní mají konkurenční výhodu, a také uživatelské firmy, které z této výhody rovněž těží.

Abstract:

This diploma thesis focuses on temporary agency work in the internal market of EU. The aim of the thesis is to provide an analysis of the aspects of agency employment in the EU member states, as well as the differences between them. The thesis is divided into two parts, the first part provides a terminological basis and a list of legal norms important for the second - practical - part. With regard to the hypothesis, in the second part the following situations and documents are analyzed: developments and breakpoints related to agency employment, current EU and national regulations and related restrictions (if any), relations between number of agency workers and GDP, or other statistical data relevant for the topic. The cross-border dimension of agency employment, which can not be omitted in connection with the current discussion between the original and the new EU states, enters into individual chapters throughout the practical part of the thesis. This topic are directly affected by areas such as labor law and social security, which are part of the EU's social policy, but competencies in this area are primarily in the hands of the Member States. However, the EU in this area can act as a partner for all stakeholders and set common goals such as the amendment of the Posting of the Workers Directive. This amendment is a response to the social dumping arising from cross-border employment in the EU. In practice, it is often the case that a worker posted from the eastern Member States to the western ones receives a salary corresponding to the country in which he is employed, not the one to whom he is posted. However, the question, remains to what extent the new regulatory settings will be accepted by the eastern Member States, whose workers have now a competitive advantage, as well as the user companies that also benefit from this situation.
