Legal Regulation of International Trade with Dual-use Technology

Abstract:

This thesis deals with the regulation of international trade with dual-use technologies, in particular with various aspects of international regime improving export controls for security reasons. First, we discuss the plethora of international initiatives, measures and agreements regulating this field, with strong emphasis on understanding their legal nature and practical non-proliferation purpose. Then we focus on the EU dual-use export controls. Current regime under Regulation 428/2009 is confronted with the model legislation on export controls in order to measure its qualities and drawbacks. Moreover, we try to search for a balance between commercial and security interests, which is the cardinal point in discussion about dual-use export controls. In the third chapter, national level of regulation, illustrated on the case of the Czech Republic, is of our main concern. We try to describe not only administrative authorisation process and its decision-making procedures, but also wider range of issues in order to understand dual-use export control regime as a functional system. In concluding chapter, we judge the observable implications of our theoretical hypothesis, claiming that the complexity and globalized nature of sensitive technology proliferation makes legal regulation more international, since it reacts very dynamically on actual challenges of the international environment.

Abstract:

Bakalárska práca sa zaoberá reguláciou medzinárodného obchodu s technológiami dvojakého použitia (dual-use), so zameraním na rozličné aspekty medzinárodného režimu upravujúceho kontrolu exportu z bezpečnostných dôvodov. V prvej časti sú predmetom nášho záujmu medzinárodné iniciatívy, opatrenia a dohody regulujúce túto oblasť, a to s dôrazom na porozumenie ich právnej povahy a praktický protiproliferačný účel. Potom sa zameriavame na kontroly exportu v Európskej únii. Súčasný režim upravený Nariadením č. 428/2009 konfrontujeme s odborníkmi vypracovaným modelovým zákonom kontroly exportu s cieľom preskúmať kvality a nedostatky nariadenia. Okrem toho sa pokúšame hľadať rovnováhu medzi komerčnými a bezpečnostnými záujmami, čo je kardinálnym bodom diskusie o kontrole exportu technológií s dvojakým použitím. V tretej kapitole študujeme regulačné snahy na národnej úrovni, ilustrované na prípade Českej republiky. Pokúšame sa opísať nielen autorizačný (licenčný proces) a s tým súvisiace rozhodovacie postupy, ale tiež širší rozsah problémov s cieľom porozumieť kontrole exportu dual-use technológií ako funkčnému systému. V závere posudzujeme pozorovateľné implikácie teoretickej hypotézy, podľa ktorej sa vzhľadom na komplexitu a globalizovanú povahu šírenia citlivých technológií stáva jeho regulácia predmetom medzinárodného práva, pričom veľmi dynamicky reaguje na aktuálne výzvy medzinárodného prostredia.
