Alternative Punishments in Czech Legal System

Abstract:

Předmětem bakalářské práce „Alternativní tresty v právním řádu ČR“ je deskripce právních, sociálních, výchovných a dalších aspektů alternativních sankcí z teoretického i praktického hlediska. Jejím cílem pak je nejen podat celkový přehled o oblasti alternativních trestů z posice práva, ale i načrtnout potenciál využití poznatků jiných společenských věd za účelem nastínění možného zvýšení efektivity výkonů těchto trestů. Práce obsahuje pojednání o jednotlivých alternativních sankcích jak u dospělých, tak u mladistvých pachatelů. Zvláštní pozornost je zde věnována trestu obecně prospěšných prací, a to jak z pohledu právní úpravy, tak i institucí, které se přímo podílejí na jeho výkonu. Nechybí ani nástin možného využití vybrané společenské vědy (konkrétně sociální pedagogiky) a jejích metod při působení na pachatele v rámci těchto trestů.

Abstract:

The subject of the Bachelor Thesis „Alternative Punishments in Czech Legal System“ is the description of the legal, social, educational and other aspects of the alternative sanctions from the theoretical and also practical standpoints. The aim is not only to refer the general, juristic review of the alternative penalty domain but also to outline the scheme of possibilities how to utilise the other social sciences knowledge in order to delineate possibilities of increase the execution of these punishments. The Thesis contains essays about the separate alternative sanctions as at the adult persons, so at the teenage offenders. In this bachelor thesis is the special attention devoted to the community service sentence and not only from the juristic review but also from the institutions´ review participant on this penalty´s execution. Either the outline of the possible utilization of the selected social science (to speak concretely: the social pedagogic) and of its methods doesn´t miss at the incidence to the offender in the frame of these punishments.
