Dispute settlement of BITs Concluded between the EU Member States

Abstract:

Tato diplomová práce se soustřeďuje na dvoustranné investiční dohody uzavřené výhradně mezi členskými státy Evropské unie (tzv. intra-EU BIT) a jejich střet s právem Evropské unie. Zaměřila jsem se především na dva nejpalčivější problémy spjaté s intra-EU BIT, jejich platnost a konflikt s právem Evropské unie. Cílem této práce je zjistit, zdali intra-EU BIT po vstupu členského státu do Evropské unie zůstávají v platnosti a do jaké míry jejich ustanovení odporují právu Evropské unie. Práce je strukturována do tří kapitol. V první kapitole, která následuje po úvodu, je nastíněna historie a vývoj dvoustranných investičních dohod v Evropské unii s akcentem na intra-EU BIT.Druhá kapitola se zabývá otázkou platnosti intra-EU BIT. Platnost intra-BIT je konfrontovaná s jednotlivými možnostmi ukončení mezinárodních smluv, které poskytuje Vídeňská úmluva o smluvním právu. Třetí kapitola je zaměřena na konfliktní oblasti týkající se toku investic a jejich ochrany mezi ustanoveními intra-EU BIT a práva Evropské unie. Jednotlivé oblasti jsou rozebírány z pohledu práva Evropské unie a mezinárodního investičního práva. Tato komparace pak následně vede k zamyšlení, zdali si ustanovení intra-EU BIT s právem Evropské unie odporují.

Abstract:

This thesis focuses on bilateral investment treaties concluded solely between the Member States of the European Union (ie. intra-EU BITs) and its conflict with the European Union law. I have focused on two most pressing problems related to the intra-EU BIT, its validity and conflict with the European Union law. The aim of this work is to determine whether the intra-EU BIT after the accession of the Member States to the European Union remains valid and to what extent their provisions are inconsistent with the European Union law. The work is divided into three chapters. In the first chapter, which follows after the introduction, the history and development of the bilateral investment treaties in the European Union with an emphasis on the intra-EU BIT are outlined. The second chapter deals with the question of validity of the intra-EU BIT. The validity of the intra-EU BIT is confronted with each termination option of international treaties, which are provided in the Vienna Convention on the Law of Treaties. The third chapter focuses on conflict areas regarding the flow of investment and its protection between the provisions of the intra-EU BIT and the EU law. Each area is analyzed from the perspective of the European Union law and international investment law. Afterwards this comparison leads to consideration whether provisions of the intra-EU BIT and the EU law are inconsistent.
