On the Way towards Democracy. Comparison of the Starting Points of Democracy Building Process in the USA and Czechoslovakia after 1989

Abstract:

Diplomová práce je zaměřena na porovnání vzniku ústavy Spojených států amerických z roku 1787 a ústavy České republiky z roku 1993 a to z několika předem vybraných hledisek. Prvním z nich je srovnání historicky – politického období, ve kterém obě výše uvedené ústavy vznikly a současně posouzení vlivu změny formy vlády či politického režimu na vznik ústavy. Dalším aspektem komparace je zohlednění historické zkušenosti, jež byla následně reflektována v podobě mnohých ustanovení daných ústav. Dále jsou definovány skutečnosti, od kterých se chtěli čeští i američtí ústavodárci distancovat a jakými prostředky toho chtěli docílit a naopak, co považovali za natolik zásadní, že to muselo být vloženo do ústavy a nikoli do běžných zákonů. V souladu s uvedeným jsou analyzovány i postoje a názory českých a amerických ústavodárců, které byly zdrojem idejí a principů, jenž následně byly zakotveny jak do české ústavy z roku 1993, tak do americké ústavy z roku 1787. Závěrečným východiskem celé práce je konstatování, že tvorba nové ústavy je i v 21. století aktuálním tématem, jelikož státy se svými formami vlády i politickými režimy jsou neustále se měnícím a vyvíjejícím organismem, přičemž ústava Spojených států amerických z roku 1787 zůstává stále vzorem pro vytváření nových demokratických ústav a to z důvodu stručnosti a výstižnosti svého textu, oproti ústavě České republiky z roku 1993, přičemž ale Česká republika disponuje modernějším zněním katalogu základních lidských práv a svobod, což je dáno skutečností, že předmětný český katalog základních práv a svobod vznikl jako Listina základních práv a svobod v roce 1991, respektive 1993, tedy mohl již reflektovat závazky z mezinárodních smluv, kterými byla a je Česká republika vázána.

Abstract:

The thesis is focused on the comparison the United States Constitution of 1787 with the Czech Republic Constitution of 1993 using several pre-selected criteria. At first, the comparison of the historical-political period is given and at the same time the impact of changes in the form of government or political system for the formation of the constitution is assessed. Another aspect of the comparison implies the evaluation of historical experience, which was subsequently reflected in the form of several provisions of the constitutions. Furthermore, the issues which Czech and American constitution-makers intended to refrain from are defined as well as the means how to do so. And the issues which were considered to be incorporated in the constitution and not in ordinary laws are mentioned. Then, Czech and American constitution-makers' opinions and attitudes are analysed. These ideas became the sources of the principles which were subsequently set out in both the Czech Constitution of 1993 and the United States Constitution of 1787. There is also the comparison of the catalogue of fundamental rights and freedoms, its wording and integration into the general legal system of both the Czech Republic and the United States of America. The final conclusion of the thesis is the finding that the formation of the new constitution is still an up-to-date topic even in the 21st century, as states, with their forms of government and political regimes are a constantly changing and evolving organism. The Constitution of the United States of America of 1787 still serves as an example for creating new democratic constitutions thanks to its brevity and conciseness of the text, on the contrary to the Constitution of the Czech Republic of 1993. However the Constitution of the Czech Republic of 1993 has a more contemporary wording of the catalogue of fundamental human rights and freedoms which is due to the fact that the respective present Czech catalogue of fundamental rights and freedoms was established as the Charter of Rights and Freedoms in 1991 or 1993 and therefore could reflect the commitment of the international treaties, which were binding for the Czech Republic at that time.
