Collective bargaining and collective agreements

Abstract:

This bachelor thesis deals with one of the sections of the labour law which is collective labour law. Aim of the work is to zoom in the issue of collective bargaining, which results in the conclusion of a collective agreement. The first chapter is focused on the introduction to employment law. Describes the issues of collective labour law at the international level of the historical and the current perspective. Part of the first chapter is also to emphasise the importance of international institutions of protection work. The second chapter deals with social dialogue at the national level, which we call the tripartism. Subsequently, discusses the issue of the need of social dialogue in order to achieve social settlement. In the third chapter are defined rules and the process of collective bargaining. Great attention is devoted to the subjects of collective bargaining, which form the basic pillar of the whole negotiations. The fourth chapter provides a consolidated view of the subject matter, content, validity, binding effect of collective agreements in terms of individual levels of collective bargaining. The fifth chapter deals with collective labour disputes. Described is the process of resolving the dispute before the intermediaries and arbitrators. In labour disputes, pressure actions have a unique position in the form of strikes and lockouts. The practical part analyzes the conditions of remuneration agreed upon in the collective agreement a higher degree valid for the companies of the chemical and pharmaceutical industries and in company collective agreements of companies involved in chemistry in Poprad region. The financial benefits of the employees of these companies are compared with the legislative treatment of remuneration.

Abstract:

Bakalárska práca sa zaoberá jednou z častí pracovného práva a to kolektívnym pracovným právom. Cieľom práce je priblížiť problematiku kolektívneho vyjednávania, ktorého výsledkom je uzatvorenie kolektívnej zmluvy. Prvá kapitola je zameraná na úvod do pracovného práva. Popisuje problematiku kolektívneho pracovného práva na medzinárodnej úrovni z historického aj súčasného pohľadu. Súčasťou prvej kapitoly je aj zdôraznenie významu medzinárodných inštitúcii ochrany práce. Druhá kapitola sa zaoberá sociálnym dialógom na národnej úrovni, ktorý nazývame tripartita. Následne rozoberá problematiku potreby sociálneho dialógu s cieľom dosiahnutia sociálneho zmieru. V tretej kapitole sú definované pravidlá a proces kolektívneho vyjednávania. Veľká pozornosť je venovaná subjektom kolektívneho vyjednávania, ktoré tvoria základný pilier celého vyjednávania. Štvrtá kapitola poskytuje ucelený pohľad na predmet, obsah, platnosť, záväznosť a účinnosť kolektívnych zmlúv z hľadiska jednotlivých úrovní kolektívneho vyjednávania. Piata kapitola sa zaoberá kolektívnymi pracovnými spormi. Popísaný je proces riešenia sporu pred sprostredkovateľom a rozhodcom. V pracovnoprávnych sporoch majú výnimočné postavenie nátlakové akcie v podobe štrajku a výluky. Praktická časť analyzuje dohodnuté podmienky odmeňovania v kolektívnej zmluve vyššieho stupňa platnej pre spoločnosti chemického a farmaceutického priemyslu a v podnikových kolektívnych zmluvách spoločností podnikajúcich v odvetví chémie v popradskom regióne. Finančné výhody zamestnancov týchto spoločností sú porovnávané s legislatívnou úpravou odmeňovania.
