Perceived credibility of the witness's decision during recognition depending on the verbal and numerical expression of the level of witness's certainty by the legal community in the Czech Republic

Abstract:

Rekognice osoby je jedním ze zvláštních způsobů dokazování v trestním řízení, který spočívá ve znovupoznání pachatele svědkem. Dosavadní výzkumy a praxe odhalily mnoho vlivů, které mohou nežádoucím způsobem zasáhnout do procesu tohoto znovupoznání. Z dosavadních studií pak vyplývá, že odborná právnická veřejnost (soudci, státní zástupci a advokáti) jsou při posuzování důvěryhodnosti rekognice nejvíce ovlivněni svědkem vyjádřenou mírou jistoty. Tuto ovšem může svědek vyjádřit různými způsoby, a to od slovních vyjádření míry jistoty až po vyjádření numerická. Tyto vyjádření míry jistoty jsou v práci doplněny o novou metodu vyjádření jistoty prostřednictvím lexikonu, která spojuje slovní, numerické a grafické vyjádření míry jistoty. Cílem práce bylo zjistit, zda jsou různé způsoby vyjádření totožné míry jistoty svědka vnímány právnickou veřejností v České republice stejně, či nikoliv.

Abstract:

Recognition is one of the special methods of evidence in criminal proceedings, which consists of the recognition of the perpetrator by a witness. Previous research and practice have revealed many influences that can adversely affect the process of this recognition. From the studies available up to date, it follows that when assessing the credibility of recognition, the professional legal public (judges, prosecutors, and lawyers) are most influenced by the level of confidence expressed by the witness. However, the witness can express confidence in different ways, from verbal expressions to numerical expressions of the degree of confidence. In this thesis, these expressions are supplemented with a new method of expressing the degree of certainty through a lexicon, which combines verbal, numerical, and graphic expressions of the degree of confidence. The aim of the thesis was to find out whether different ways of expressing the same level of confidence of a witness are perceived the same way by the legal public in the Czech Republic or not.
