The reform of the administrative criminal law

Abstract:

Diplomová práce je zaměřena na porovnání právní úpravy správního práva trestního vzhledem k její reformě, jež nabyla účinnosti dne 1. 7. 2017. Cílem práce je analyzovat, zda se zákonodárci podařilo odstranit vytýkané legislativní nedostatky a zda současná právní úprava může vyvolat nové praktické problémy. Za účelem naplnění cíle práce úvodem charakterizuje základní pojmy správního trestání a uvádí typologii správních deliktů. V práci jsou dále uvedeny vytýkaná negativa právní úpravy účinné do 30. 6. 2017 a s tím související nutnost judikaturního řešení těchto nedostatků. Část práce je věnována také vlivu reformy správního práva trestního do oblasti zásad trestání. Závěrečná část je rozborem vybraných změn v hmotněprávní i procesněprávní části správního práva trestního.

Abstract:

The diploma thesis focuses on the comparison of the legal regulation of administrative criminal law with regard to its reform, which came into effect on 1st July 2017. The aim of the thesis is to analyze whether the lawmakers managed to eliminate the alleged legislative shortcomings and whether the current legislation can create new practical problems. In order to achieve the aim of the thesis, there are introduced the basic concepts of administrative punishment and described the typology of administrative delicts. The thesis also contains the criticized negatives of the legal regulation effective until 30th June 2017 and the related necessity of the case law solution of these shortcomings. Part of the thesis also deals with the impact of the reform on the principles of punishment. The final part is an analysis of selected changes in substantive and procedural parts of criminal law.
