Theory and Practice of Legislative Initiative of the Regional Council in the Czech Republic

Abstract:

Diplomová práce se věnuje tématu zákonodárná iniciativa krajů České republiky. Klade si za úkol zmapovat legislativní proceduru předkládání novel zákonů, jimiž autory jsou vyšší územně samosprávné celky. Taktéž zkoumá kvantitu a úspěšnost předložených návrhů napříč Českou republikou. Zákonodárná iniciativa se navenek zdá být opomíjena a práce krajů přehlížena. Prosadit své poznatky a potřeby na půdě Parlamentu České republiky je práce nesnadná, ale úsilí každého jednoho kraje je přínosem pro všechny kraje. Jednotlivé návrhy čerpají poznatky z přímé implementace zákonů v praxi a jsou schopny na mezery pružně reagovat, a to i tam, kam zákonodárce nevidí. Takovým příkladem je novela zákona č. 500/2004 Sb. správní řád, jehož cesta ke schválení je v práci sledována.

Abstract:

The diploma thesis deals with the legislative initiative of regions of the Czech Republic. Its main task is to map out the legislative procedure of submitting amendments to laws whose authors are higher territorial self-governing units. It also examines the quantity and success of submitted proposals across the Czech Republic. On the outside, the legislative initiative seems to be neglected and the work of the regions overlooked. Enforcing the knowledge and needs in the Parliament of the Czech Republic is a difficult job, but the efforts of each one of the region is of benefit for all regions. Individual proposals draw knowledge from direct implementation of laws in practice and are able to respond flexibly to grey areas, even where the legislator does not see. An example of this is the amendment to Act No. 500/2004 Coll. the Code of Administrative Procedure, of which path to approval is monitored in the work.
