Abstract:

Pro současnou společnost je jedním ze závažných problémů delikvence dětí a mladistvých. Stát i nestátní instituce se snaží hledat příčiny tohoto jevu a eliminovat jeho důsledky. Ke snížení kriminality dětí směřují i nové trendy v trestní justici, především zavádění prvků restorativní justice do soudní praxe. Práce se zabývá problematikou delikvence mladistvých a možnostmi jejich resocializace v rámci probačních programů. Probační programy jsou novým výchovným opatřením, které je ze zákona možno uložit mladistvým, kteří se dopustili protiprávního jednání. Cílem práce je analýza a komparace tří probačních programů, které v současné době probíhají na území Královéhradeckého kraje. V teoretické části práce je nejprve věnována pozornost pojmu restorativní justice a jejímu vývoji u nás i v zahraničí. Dále se práce zabývá právním rámcem pro realizaci principů restorativní justice v českém právním řádu, především pak zákonem o soudnictví ve věcech mládeže. Teoretická část dále obsahuje kapitoly zabývající se systémem péče o delikventní mládež v České republice a vývojem trestné činnosti dětí a mladistvých. Klíčová je část věnovaná problematice probačních programů, systému jejich akreditace a jejich realizaci v praxi. Praktická část práce navazuje na teoretickou část a snaží se o naplnění stanoveného cíle, tedy o analýzu a srovnání tří zkoumaných probačních programů. Úvodní kapitola je věnována metodologii výzkumného šetření, dále jsou předloženy zjištění z tohoto šetření. Zkoumané probační programy jsou nejprve popsány, následuje jejich srovnání a hodnocení na základě vymezených kategorií.

Abstract:

Juvenile delinquency is one of the most painful problems of the current society. Both governmental and nongovernmental institutions try to find the causes of this problem and eliminate its consequences. There are also new trends within the criminal justice sphere that aim to reduce the juvenile delinquency {--} especially the introduction of elements of the restorative justice. The thesis deals with a problem of the juvenile delinquency and examines possibilities of resocialization of the delinquents within the probation programs. Probation programs are a new educational measure that may be imposed on the juveniles who have broken the law. The main goal of the thesis is to analyse and compare three probation programs that are currently running in the Hradec Králové district. Firstly, the theoretical part focuses on the term restorative justice and on the development of restorative justice both in the Czech Republic and abroad. Secondly, a legal framework for implementation of principles of restorative justice in the Czech law is discussed, particularly the law about judicature dealing with matters of juveniles. Theoretical part also contains chapters concerning a system of care about juvenile delinquents in the Czech Republic and outlines a development of criminality of the youth. Key part of the text is dedicated to problems of probation programs, system of their accreditation and their practical realization. Practical part of the thesis comes after the theoretical part and aims to fulfill the main goal that was set {--} i.e. the analysis of three examined probation programs. Introductory chapter deals with methodology of the research, then the findings of the research are presented. Examined probation programs are first of all described, after that follows their comparison and evaluation based on defined categories.
