Normative legal regulation of civil aviation protection against unlawful acts in the Czech Republic and the European Union

Abstract:

Tato diplomová práce navazuje na bakalářskou práci, která byla vypracována v rámci bakalářského studia na stejné škole. Zabývá se tedy normativními právními úpravami ochrany civilního letectví před protiprávními činy v České republice a Evropské unii. Popisuje začátky civilního letectví a z toho plynoucí potřebu ochrany pomocí zákonných norem, vyjmenovává a popisuje nejdůležitější pojmy, které se vyskytují v oblasti letectví v souladu se zadáním diplomové práce konkrétně v letectví civilním. Dalším obsahem diplomové práce je seznámení se se subjekty, které se v civilním letectví pohybují a ovlivňují ho. Část práce se věnuje analýze, jak jsou normativní právní akty uplatňovány, jaké má jejich uplatňování důsledky, zda jsou právní normy redundantní a jaká je efektivita kontrol, které jsou zaměřeny na jejich respektování v běžném provozu. Jako na hlavní cíl se pak diplomová práce zaměřuje na vytvoření návrhu struktury jednotného kodexu bezpečnostních opatření, který dnes v této oblasti chybí tak, aby ty nejdůležitější a nejpoužívanější právní normy byly sjednoceny na jednom místě. Cíl v praxi je tedy takový, že člověk, který potřebuje pracovat s normativními právními akty, bude moct nahlédnout do jednotného kodexu a tím ušetří spoustu času hledáním předmětných právních norem.

Abstract:

This diploma thesis is a continuation of the bachelor thesis, which was prepared during the bachelor study at the same school. It therefore deals with the normative legal regulations of civil aviation security in the Czech Republic and the European Union. It describes the beginnings of civil aviation and the resulting need for protection by means of legal standards, lists and describes the most important concepts that occur in the field of aviation and in accordance with the assignment of the diploma thesis specifically in civil aviation. Another content of the thesis is the author's acquaintance with entities that move and influence in civil aviation. The author devotes a part of the thesis to the analysis of how the normative legal acts are applied, what the consequences of their application are, whether the legal standards are redundant and what is the effectiveness of the checks, which are focused on their respect in normal operation. The main aim of the thesis is to create a proposal for the structure of a single code of security measures, which is currently missing in this area so that the most important and most used legal standards are unified in one place. The aim in practice is, therefore, that a person who needs to work with normative legal acts will be able to look into a single code of conduct and thus save a lot of time searching for the legal norms in question.
