Unresolved issues of reform of legal regulation of political parties funding in the Czech Republic

Abstract:

Záměrem této práce, kterou tak lze považovat za jakési „širší souvislosti regulace financování politických stran“ či „vyhodnocení okolností pro zvažovanou přípravu reformy“, je spíše upozornit na nedostatky a problematické aspekty přístupu ovlivněného „proregulačním“ nadšením či „anti-korupční“ obsesí, pod jejichž vlivem je prezentováno nepřeberné množství návrhů, nových přístupů, revolučních, komplexních či jednorázových léčivých řešení otázky regulace financování politických stran, aniž by byla důkladně zvážena odpověď na první z uvedených otázek a všechny problematické aspekty jeho předložení předcházející. Kladná odpověď na ni je totiž jaksi automaticky presumována, a to za jakékoli situace. Reforma právní regulace financování politických stran se tak v našem prostředí stala v podstatě permanentní, přičemž v důsledku rovněž permanentně plánovaného boje s korupcí ve veřejné sféře se požadavky na její přijetí neustále zintenzívňují, tedy alespoň z hlediska jejich publicity. Tomu se ve své práci snažím čelit právě nastolením neřešených či dosud přehlížených problematických otázek spojených s regulací financování politických stran v ČR.

Abstract:

On the previous pages of my work: “Unresolved issues of reform of legal regulation of political party funding in the Czech Republic” I have tried to point out some unsolved and should be added that even not asked problematic issues and questions related to the legal regulation of political party funding in the Czech Republic. My opinion is that under the influence of "pro-regulation" enthusiasm and due of the so called mystification effect (potential) of the prevention of corruption ("anti-corruption obsession") are almost permanently in the public sphere submitted new and "really effective" proposals how to regulate particular political party funding, especially from private sources, which conceal the threat of corruption in the public sector. One of these effective regulations is considered the adoption of strict rules and regulations of private financing of political parties. Against this "pro-regulation" enthusiasm I tried to face with defining the key aspects and issues which the control of political parties funding and the polycentric nature of it bears.
