Abstract:

Annotation SISÁK, Andrea: Bankruptcy of a physical person - debt relief under the Act on Bankruptcy and Restructuring [Bachelor thesis]. Bank Institute University of Prague, Foreign University Banska Bystrica. Department of Economics, valuation, Social Sciences and Law. Supervisor of thesis: JUDr.Slavomír Dubjel, Year : 2013, number of pages 51. Bachelor thesis deals with a cross-section of bankruptcy from the perspective of the physical person-the debtor and the subsequent possibility of settlement of liabilities in the form of debt relief after bankruptcy. The first chapter describes the situation when the person becomes insolvent and further conditions of decline at an individual entrepreneur as well as in non-entrepreneur. The second chapter focuses on pre-insolvency stage, specifically to submit a proposal for a declaration of bankruptcy by the debtor itself or the creditors. This chapter provides procedural and formal conditions which must comply with the proposal. The third chapter describes bankruptcy and its contents in detail. This part of the thesis describes the process of bankruptcy from its declaration to the end, position of secured and unsecured creditors in the bankruptcy, the process of realization and satisfaction of creditors through the allocation of yields. Part of the third chapter is a description of the contents of a small bankruptcy. The last chapter analyzes the Institute of debt relief which is subsequently after bankruptcy. And its conditions for which it is possible to submit a proposal for the debt relief as well as the procedure of the debtor, trustee and the court during a trial period in relief. In conclusion are stated the findings which can be reached after studying the previous chapters. Key words: bankruptcy, a physical person, trustee, creditors, court, debt relief, a trial period

Anotácia SISÁK, Andrea: Konkurz fyzickej osoby - oddlženie podľa zákona o konkurze a reštrukturalizácii. [Bakalárska práca]. Bankovní institút vysoká škola Praha, zahraničná vysoká škola Banská Bystrica. Katedra ekonómie, oceňovania, spoločenských vied a práva. Vedúci práce: JUDr. Slavomír Dubjel. Rok obhajoby: 2013, počet strán 51. Bakalárska práca sa zaoberá prierezom konkurzu z pohľadu fyzickej osoby - dlžníka a následnou možnosťou vysporiadania záväzkov formou oddlženia po ukončení konkurzu. Prvá kapitola popisuje stav, keď sa fyzická osoba dostane do platobnej neschopnosti, ďalej podmienky úpadku a to ako pri fyzickej osobe podnikateľa tak aj u nepodnikateľa. Druhá kapitola je zameraná na predkonkurzné štádium, konkrétne na podanie návrhu na vyhlásenie konkurzu dlžníkom samotným, alebo veriteľom. V tejto kapitole sú uvedené procedurálne a formálne podmienky, ktoré musí návrh spĺňať. Konkurzné konanie a jeho obsah detailne popisuje tretia kapitola. V rámci tejto časti práce je popísaný celý proces konkurzu od jeho vyhlásenia až po jeho ukončenie postavenie zabezpečených a nezabezpečených veriteľov v konkurze, proces speňažovania a uspokojenie veriteľov prostredníctvom rozvrhu výťažku. Súčasťou tretej kapitoly je popis a obsah malého konkurzu. Posledná kapitola analyzuje inštitút oddlženia, ktorý je následne po ukončení konkurzu. A jeho podmienky, za ktoré je možné podať návrh na oddlženie ako aj postup dlžníka, správcu a súdu počas skúšobného obdobia v oddlžení.
