Abstract:

Tématem bakalářské práce je především analýza pojmu Volonté générale, neboli Obecná vůle, jako jednoho ze základních pojmů teorie společenské smlouvy u J. J. Rousseaua. Teorie společenské smlouvy se podle Rousseaua zrodila z obecné dohody mezi lidmi, kteří změnili svojí formu bytí z přírodního stavu do občanské, civilní společnosti. Stali se tak svrchovanou mocí státu, jenž je nezcizitelná a nedělitelná. Přijetím společenské smlouvy se lidé podvolili zákonům, jež si sami stanovili. Občané státu nepřicházeli o své svobody, navíc měli možnost kdykoli úmluvu zrušit. Cílem mé práce je teorie Jeana Jacquesa Rousseaua, ale nejprve se práce zabývá životem autora. Následující kapitoly se zaměřují na přirozený stav lidí a problém svobody, jaký je rozdíl mezi vůlí všech a obecnou vůlí, jak vznikla obecná vůle na základě společenské smlouvy, a na závěr uvádí Rousseauovo pojetí zákonodárné moci a jejího vztahu k výkonné moci a proč Rousseau odmítal zastupitelskou demokracii.

Abstract:

The theme of this bachelor thesis is to formulate and extend the concept of Volonté générale as it is the basic idea in the theory of general will. The theory of general will originated as an agreement among people who changed their being from the state of nature to civil society. The people became the sovereign power which is imprescriptible and indivisible. If the general will is received, people submit to the law that they established themselves. The aim of the work is to understand better Jean Jacques Rousseau and the dilemma of will in general which is discussed in book Social Contract. The thesis also deals with Rousseau?s life. Further chapters are concerned with peoples? nature state, questions of freedom, the differences between one?s will and the general will, and how the general will originated. And finally the thesis discusses Rousseau?s concept of legislative and executive power and the reason why was he rejected.
